We work closely with our clients and where applicable their financial advisers, accountants, and foreign lawyers to understand their priorities to enable us to advise on the most tax-efficient ways of passing and securing wealth for future generations. Trusts are not the only tool available to families and the team will review the tax exposure of families and individuals when advising on wealth preservation strategies.
The team deals with the creation and registration of both lifetime trusts and will trusts, providing expert and clear advice to clients to ensure the best fit for the client’s individual needs. The team can also advise on potential changes to existing trust arrangements and how to deal with a trust set up in a will following a death.
We are also frequently consulted in respect of the ongoing management of trusts by trustees. This can include advising in relation to the ongoing tax obligations and filings, the acquisition and disposal of assets, and distributions to those entitled to benefit from the trust. We can also assist with winding up trusts and any resulting tax liability.
The team also prepares declarations of trust to set out the beneficial interests in properties where these are not identical to the legal ownership and can assist with registering trusts through the Trust Registration Service where registration is required.
