Het scheidingsproces voor huwelijken en het ontbindingsproces voor burgerlijke partnerschappen bestaat meestal uit twee delen:

The distribution of the parties’ assets (‘financial remedy or simply ‘finances’).

1. The legal termination of the marriage or civil partnership (the divorce/dissolution process)

In England and Wales there is only one ground for divorce and that is that the marriage or civil partnership has broken down irretrievably. This can be proven by one or more of the following facts:

1. Overspel

2. Gedrag, ook wel ‘onredelijk gedrag’ genoemd, kan worden gebruikt als je echtgenoot zich zo heeft gedragen dat redelijkerwijs niet van je kan worden verwacht dat je bij hem of haar blijft wonen.

3. Er is sprake van desertie als je echtgenoot of echtgenote je voor een aaneengesloten periode van twee jaar of meer heeft verlaten;

4. Twee jaar scheiding wanneer u en uw echtgeno(o)t(e) twee jaar of langer apart hebben gewoond

5. Vijf jaar scheiding wanneer u en uw echtgeno(o)t(e) vijf jaar of langer apart hebben gewoond

If your spouse cooperates with the divorce, then the procedure zal take between 4-6 months to complete. The court fee for issuing a divorce or dissolution petition is £593.00 and we are able to work on a fixed fee basis for our legal costs provided this is appropriate in your circumstances.
