Case Study: Successful Assylum Appeal

The immigration team at Ronald Fletcher Baker LLP were recently instructed by a client who lived outside of London and spoke limited English. Having already spent considerable time and money with previous solicitors, the client was dissatisfied with the service received and sought to change representation.

When he approached us, his appeal had been prepared only to a basic standard, with just a few months remaining before the final hearing. Recognising his situation, we offered a reduced fee given the late stage of instruction, and immediately began strengthening his case. Our team prepared an addendum bundle that included a new detailed witness statement from his partner, supporting evidence, objective evidence, and a comprehensive skeleton argument drafted by experienced Counsel whom we instructed.

Throughout the process, we maintained regular contact with the client, ensuring he was fully informed and prepared for his hearing. Despite the time constraints and the complexity of the case — particularly as the Home Office disputed the client’s nationality — the appeal was successful.

A few weeks after the hearing, the client’s appeal was allowed, and he was promptly granted Refugee Status by the Home Office.

  • Prepare your bundle thoroughly including by taking the relevant witness statements, drafting a skeleton argument, collating the subjective and objective evidence in your case and the strengths of this evidence, advising you on whether an expert report might be needed
  • Advising you on the contents of the Home Office’s review of your bundle and responding to this if appropriate
  • Representing you at a hearing and having a conference with you in advance of the hearing so you are familiar with the structure on the day
  • Advising you on the outcome of your appeal including any suitable remedies and relevant timeframes
  • Advising you on your rights post a grant of immigration status from the Home Office after a successful appeal
