When acting for creditors, a knowledge of the range of various insolvency procedures available and how they individually affect a creditor’s claim is crucial in order to gain an advantage in litigation. Acting early in an insolvency process can widen the options available to creditors. Indeed, implementing insolvency proceedings against debtors can often be not only necessary but an effective method of making a debtor deal with debt. 

We are also instructed by insolvency practitioners in order to pursue potential directors’ disqualification and antecedent transaction proceedings for the benefit of the creditors. We also have experience in dealing with joint tortfeasor claims against directors. 

We have a vast amount of experience in acting for debtors who wish to oppose insolvency proceedings. We regularly make applications to set aside personal statutory demands and injunctions to prevent winding-up petitions. It is important that debtors do not ignore insolvency proceedings and take action to either oppose the same or commence negotiations for payment plans.
