Your frequently asked questions

Family Visas are available to spouses, partners, children, and dependent relatives of individuals settled in the UK or British citizens. 
Typically, Family Visas are granted for 2.5 years, with the option to extend and after completing five years on your given route, you can apply for Indefinite Leave to Remain.
You must prove your relationship is genuine, meet financial requirements, and show adequate accommodation in the UK.
Yes, Spouse Visa holders are permitted to work and study in the UK.
It is valid for 6 months, during which you must marry or enter a civil partnership.
Yes, once married, you can apply to switch to a Spouse Visa from within the UK. However, your six months of stay does not count towards your 5-year route to settlement.
Parents of children who are British citizens or settled in the UK may apply, provided they play an active role in the child’s upbringing.
Yes, you must demonstrate the ability to support yourself without relying on public funds.
No, applications must be made by or with their parent or guardian.
Generally, children under 18 qualify, though older dependents may be eligible in certain circumstances.
Elderly or vulnerable relatives who rely on long‑term care from family members in the UK.
It is one of the most challenging visas to secure, requiring strong evidence of dependency and care needs.
ILR grants permanent residency, allowing you to live and work in the UK without restrictions.
Usually 5 or 10 years, though some categories allow earlier applications.
You must hold ILR, meet the residency requirements, pass the Life in the UK Test, demonstrate the required level of English language proficiency, and be of good character.
Yes, children born in the UK to a British or settled national may be eligible either automatically or through registration, depending on their circumstances.
Pre‑Settled Status is temporary (usually 5 years), while Settled Status grants permanent rights to live and work in the UK.
EEA and Swiss nationals (and their family members) who were living in the UK before the Brexit transition deadline can apply. In some circumstances, family members who are currently living abroad can apply for Pre-Settled status to join their family living in the UK.
Appellants with legal representatives are usually more likely to win an appeal. RFB’s immigration team has the knowledge and experience to be able to help with your appeal no matter how complex it may seem. The team carries out a wide variety of appeal work, and has a success rate in appeals.
We will review your case papers thoroughly and take your instructions and advise you on whether we think it would be beneficial to instruct a barrister in your appeal. This will depend on the complexity of the appeal, the relevant time frame and the capacity of the team to attend the hearing.
No, we do not work on a no-win-no-fee basis; however, our success is high, and we will be very upfront with you at the point of instruction on the merits of your case.
This will depend on the facts of the case and your personal circumstances. It is likely that your financial situation and the urgency of your matter will be key factors in making this decision. We will be able to advise you on this and provide on the options available to you, and the pros and cons of these options. You will then be able to make an informed decision.
