M\u00fclk sahipleri, bu pay\u0131n kald\u0131r\u0131lmas\u0131n\u0131n varl\u0131k de\u011ferinin tazminats\u0131z bir \u015fekilde el konulmas\u0131 anlam\u0131na geldi\u011fini savunuyor.\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Arsa Kiras\u0131 De\u011ferleme \u00dcst S\u0131n\u0131r\u0131:<\/strong>\u00a0Yasa, bir kirac\u0131n\u0131n kira s\u00f6zle\u015fmesini uzatmak veya m\u00fclkiyet hakk\u0131n\u0131 sat\u0131n almak i\u00e7in \u00f6demesi gereken primin hesaplanmas\u0131nda, dikkate al\u0131nan arsa kiras\u0131n\u0131n bir \u00fcst s\u0131n\u0131rla s\u0131n\u0131rland\u0131r\u0131lmas\u0131n\u0131 \u00f6ng\u00f6rerek, m\u00fclk sahibine \u00f6denecek nihai tutar\u0131 azaltmaktad\u0131r.\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Hukuki Masraflar\u0131n Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn De\u011fi\u015fimi:<\/strong>\u00a0Tarihsel olarak, kira hakk\u0131 sahipleri, m\u00fclkiyet hakk\u0131 kazanma veya s\u00fcre uzatma talepleri s\u0131ras\u0131nda s\u00f6zle\u015fme gere\u011fi m\u00fclk sahibinin uzmanl\u0131k, de\u011ferleme ve hukuk masraflar\u0131n\u0131 \u00f6demekle y\u00fck\u00fcml\u00fcyd\u00fc. 2024 Kanunu bu durumu tersine \u00e7evirerek, her bir taraf\u0131n kendi masraflar\u0131n\u0131 kar\u015f\u0131lamas\u0131n\u0131 \u015fart ko\u015fmaktad\u0131r.\u00a0<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Y\u00fcr\u00fcrl\u00fckteki H\u00fck\u00fcmler: \u015eu An Hangi H\u00fck\u00fcmler Uygulanabilir?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Temyiz Mahkemesi\u2019nin, yasan\u0131n y\u00fcr\u00fcrl\u00fc\u011f\u00fcn\u00fc durdurmak \u00fczere resmi bir ihtiyati tedbir karar\u0131 vermedi\u011fi s\u00fcrece \u2013 ki bu pek olas\u0131 de\u011fildir \u2013 y\u00fcr\u00fcrl\u00fc\u011fe girme kararlar\u0131yla halihaz\u0131rda y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f olan 2024 Kanunu\u2019nun h\u00fck\u00fcmleri tam olarak ge\u00e7erli olmaya devam eder:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u0130lk G\u00fcnden \u0130tibaren Oy Hakk\u0131:<\/strong>\u00a0Tarihi \u201ciki y\u0131l kural\u0131\u201d y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r. Kira hakk\u0131 sahipleri, kira s\u00fcresinin uzat\u0131lmas\u0131 veya toplu m\u00fclkiyet hakk\u0131 sat\u0131n al\u0131m\u0131 i\u00e7in yasal talepte bulunmadan \u00f6nce, konut ama\u00e7l\u0131 kira hakk\u0131 bulunan bir gayrimenkul\u00fc 24 ay boyunca elinde bulundurmak zorunda de\u011fildir. Bu yasal hak, m\u00fclkiyetin ilk g\u00fcn\u00fcnden itibaren ge\u00e7erlidir.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>50% Karma Kullan\u0131ml\u0131 Ticari E\u015fik:<\/strong>\u00a0Karma kullan\u0131ml\u0131 planlara sahip binalar (\u00f6rne\u011fin, perakende sat\u0131\u015f birimleri veya ticari ofislerin \u00fczerine in\u015fa edilmi\u015f daireler gibi), konut d\u0131\u015f\u0131 alan\u0131n binan\u0131n toplam i\u00e7 alan\u0131n\u0131n 50%\u2019sine kadar\u0131n\u0131 olu\u015fturmas\u0131 halinde art\u0131k toplu m\u00fclkiyet hakk\u0131 ve Y\u00f6netim Hakk\u0131\u2019ndan (RTM) yararlanabilir.
