Bir anla\u015fmaya var\u0131l\u0131p var\u0131lamayaca\u011f\u0131, taraflar\u0131n benimsedi\u011fi yakla\u015f\u0131ma ba\u011fl\u0131 olacakt\u0131r. Taraflar yeni kira s\u00f6zle\u015fmesinin t\u00fcm \u015fartlar\u0131 \u00fczerinde anla\u015fmaya var\u0131rlarsa, mahkeme karar\u0131 gerekmeksizin yenileme kiralamas\u0131n\u0131 yapabilirler. G\u00f6n\u00fcll\u00fc olarak bir anla\u015fmaya var\u0131lamazsa, a\u015fa\u011f\u0131da ayr\u0131nt\u0131l\u0131 olarak a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere belirli prosed\u00fcrler ve son tarihler izlenmelidir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ev Sahibi Ticari Kira S\u00f6zle\u015fmesini Nas\u0131l Yeniler?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Ev sahibi, kira s\u00f6zle\u015fmesinin yenilenmesi i\u00e7in <strong>B\u00f6l\u00fcm 25 bildirimi<\/strong> kirac\u0131 \u00fczerinde. Bildirimin ge\u00e7erli olabilmesi i\u00e7in&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00d6ng\u00f6r\u00fclen bi\u00e7imde olmal\u0131d\u0131r.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yetkili ev sahibi taraf\u0131ndan tebli\u011f edilmelidir.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kirac\u0131ya do\u011fru \u015fekilde hitap edilmelidir.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yasal s\u00fcre i\u00e7inde ge\u00e7erli bir \u015fekilde tebli\u011f edilmelidir (belirtilen fesih tarihinden en fazla 12 ay ve en az alt\u0131 ay \u00f6nce).\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Bildirimdeki fesih tarihi, mevcut kiralaman\u0131n s\u00f6zle\u015fmeye dayal\u0131 sona erme tarihinden \u00f6nce olamaz.&nbsp;<\/p>\n\n\n\n<p>Ge\u00e7erli bir B\u00f6l\u00fcm 25 bildirimi tebli\u011f edildikten sonra ev sahibi taraf\u0131ndan tek tarafl\u0131 olarak geri \u00e7ekilemez veya de\u011fi\u015ftirilemez.&nbsp;<\/p>\n\n\n\n<p>Ev sahibinin yenilemeye itiraz etmek istemesi halinde, \u00f6ng\u00f6r\u00fclen farkl\u0131 bir form kullan\u0131lmal\u0131d\u0131r.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kirac\u0131 Ticari Kira S\u00f6zle\u015fmesini Nas\u0131l Yeniler?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Bir kirac\u0131, yenileme i\u015flemini bir <strong>B\u00f6l\u00fcm 26 talebi<\/strong> ev sahibi \u00fczerinde. Bu talep \u015fu \u015fekilde olmal\u0131d\u0131r:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00d6ng\u00f6r\u00fclen bi\u00e7imde olmal\u0131d\u0131r.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yeni kira s\u00f6zle\u015fmesinin \u00f6nerilen \u015fartlar\u0131n\u0131 ekteki \u00e7izelgede belirtiniz.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>B\u00f6l\u00fcm 26 talebinin tebli\u011f edilmesi kirac\u0131y\u0131 yeni bir kira s\u00f6zle\u015fmesi yapmaya zorlamaz, ancak yenileme s\u00fcrecini ba\u015flat\u0131r. Kirac\u0131, s\u00f6zle\u015fme s\u00fcresi sona ermeden \u00f6nce veya kirac\u0131l\u0131k LTA 1954 kapsam\u0131nda devam ediyorsa sona erdikten sonra bir talepte bulunabilir.&nbsp;<\/p>\n\n\n\n<p>B\u00f6l\u00fcm 26 talebi:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ev sahibine, yeni kira s\u00f6zle\u015fmesinin \u015fartlar\u0131 \u00fczerinde anla\u015fmaya var\u0131lamazsa, taraflardan birinin karar i\u00e7in mahkemeye ba\u015fvurabilece\u011fini bildirir.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ev sahibinin yeni bir kirac\u0131l\u0131k i\u00e7in mahkemeye ba\u015fvurmak istemesi halinde, bunu kirac\u0131n\u0131n talebinde belirtilen ba\u015flang\u0131\u00e7 tarihinden \u00f6nce yapmas\u0131 gerekti\u011fini belirtir (taraflar aksini kabul etmedik\u00e7e).\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ev sahibine, yenilemeye itiraz\u0131n yaln\u0131zca a\u015fa\u011f\u0131da belirtilen gerek\u00e7elerden biri veya daha fazlas\u0131yla yap\u0131labilece\u011fini bildirir <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/Eliz2\/2-3\/56\/section\/30\">LTA 1954 B\u00f6l\u00fcm 30(1)<\/a>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ev sahibinin yenilemeye kar\u015f\u0131 \u00e7\u0131kmas\u0131 halinde iki ay i\u00e7inde kar\u015f\u0131 bildirimde bulunmas\u0131n\u0131 gerektirir. Bunun yap\u0131lmamas\u0131, ev sahibinin yeni bir kirac\u0131l\u0131k vermesi gerekti\u011fi anlam\u0131na gelir.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yeni kira s\u00f6zle\u015fmesinin \u00f6nerilen ba\u015flang\u0131\u00e7 tarihinden bir g\u00fcn \u00f6nce mevcut kira s\u00f6zle\u015fmesini sona erdirir.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kirac\u0131l\u0131\u011f\u0131n Yenilenmesi \u0130\u00e7in Mahkemeye Ne Zaman Ba\u015fvuru Yap\u0131lmal\u0131d\u0131r?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Taraflar yeni kira s\u00f6zle\u015fmesinin \u015fartlar\u0131 \u00fczerinde anla\u015famazlarsa, her iki taraf da a\u015fa\u011f\u0131daki h\u00fck\u00fcmler uyar\u0131nca yeni bir kirac\u0131l\u0131k emri verilmesi i\u00e7in mahkemeye ba\u015fvurabilir <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/Eliz2\/2-3\/56\/section\/24\">LTA 1954 B\u00f6l\u00fcm 24(1)<\/a>.\u00a0<\/p>\n\n\n\n<p>Kirac\u0131lar, haklar\u0131n\u0131 korumak i\u00e7in yasal s\u00fcre i\u00e7inde ba\u015fvuruda bulunmal\u0131d\u0131r.
