S\u00fcrekli ihlallere \u00f6rnek olarak m\u00fclk\u00fc onarma s\u00f6zle\u015fmesinin ihlalleri, kullan\u0131c\u0131 s\u00f6zle\u015fmesinin ihlalleri ve sigorta s\u00f6zle\u015fmesinin ihlalleri verilebilir. Kirac\u0131n\u0131n kira \u00f6demedi\u011fi durumlarda ticari ev sahibinin \u00e7\u00f6z\u00fcm yollar\u0131 hakk\u0131nda daha fazla ayr\u0131nt\u0131 i\u00e7in l\u00fctfen makalemize bak\u0131n <a href=\"https:\/\/rfblegal.co.uk\/tr\/icgoruler\/ticari-kiraciniz-kira-odemiyorsa-ne-yapmalisiniz\/\">\u201cTicari Kirac\u0131n\u0131z Kira \u00d6demiyorsa Ne Yapmal\u0131s\u0131n\u0131z?\u201d<\/a>.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Onar\u0131m Taahh\u00fcd\u00fcn\u00fcn \u0130hlali i\u00e7in Ek Gereklilikler<\/strong>&nbsp;<\/h3>\n\n\n\n<p>B\u00f6l\u00fcm 1 <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/Geo6\/1-2\/34\/contents\">Leasehold Property (Repairs) Act 1938 (LPRA 1938)<\/a> LPRA 1938'in ge\u00e7erli oldu\u011fu durumlarda ev sahibinin kira s\u00f6zle\u015fmesini feshetme yetkisini s\u0131n\u0131rlar. LPRA 1938, kira s\u00f6zle\u015fmesinin en az yedi y\u0131ll\u0131k bir s\u00fcre i\u00e7in yap\u0131lm\u0131\u015f olmas\u0131 ve en az \u00fc\u00e7 y\u0131ll\u0131k s\u00fcresinin kalm\u0131\u015f olmas\u0131 halinde ge\u00e7erlidir. Kirac\u0131 LPRA 1938'den yararlanma talebinde bulunursa, ev sahibi mahkemenin izni olmadan kira s\u00f6zle\u015fmesini iptal etmek veya onar\u0131m s\u00f6zle\u015fmesinin ihlali nedeniyle tazminat talep etmek i\u00e7in ad\u0131m atamaz.&nbsp;<\/p>\n\n\n\n<p>Kirac\u0131n\u0131n onar\u0131m taahh\u00fctlerini ihlal etti\u011fi durumlarda, ev sahibi B\u00f6l\u00fcm 146 bildirimine ihlalleri \u00f6zetleyen bir harap olma \u00e7izelgesi ekleyebilir.&nbsp;<\/p>\n\n\n\n<p>Baz\u0131 durumlarda, ev sahibi kira s\u00f6zle\u015fmesini ihlal eden bir kirac\u0131ya, ev sahibinin kira s\u00f6zle\u015fmesini feshetme niyeti olmasa bile, ihbar kirac\u0131y\u0131 ihlalleri d\u00fczeltmeye sevk edebilece\u011finden, B\u00f6l\u00fcm 146 \u0130hbar\u0131n\u0131 tebli\u011f etmeye karar verebilir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>El koyma sonras\u0131<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Ev sahibinin ticari kira s\u00f6zle\u015fmesini feshetti\u011fi durumlarda, ev sahibi i\u00e7in ba\u015fka hususlar da vard\u0131r:&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Para Cezas\u0131ndan Kurtulma<\/strong>\u00a0<\/h3>\n\n\n\n<p>Kirac\u0131 veya di\u011fer taraflar (alt kirac\u0131 veya ipotek sahibi gibi) hacizden kurtulmak i\u00e7in ba\u015fvuruda bulunabilir. Ev sahibi m\u00fclk \u00fczerinde \u00fc\u00e7\u00fcnc\u00fc bir tarafa yeni bir kira kontrat\u0131 vermek isterse, kirac\u0131n\u0131n (veya ba\u015fka bir taraf\u0131n) b\u00f6yle bir ba\u015fvuruda bulunma niyetinde olup olmad\u0131\u011f\u0131n\u0131 m\u00fcmk\u00fcn olan en k\u0131sa s\u00fcrede bilmek isteyecektir. Ev sahibi, kirac\u0131n\u0131n veya ba\u015fka bir taraf\u0131n hacizden kurtulmak i\u00e7in yapaca\u011f\u0131 ba\u015fvuruyu beklerken m\u00fclk\u00fcn bo\u015f kalmas\u0131n\u0131 \u00f6nlemek isteyecektir.&nbsp;<\/p>\n\n\n\n<p>Ev sahibi, yard\u0131m ba\u015fvurusunda bulunma hakk\u0131na sahip olanlara yeni bir kira kontrat\u0131 verilece\u011fini bildirerek ve yard\u0131m ba\u015fvurusunda bulunmay\u0131 d\u00fc\u015f\u00fcn\u00fcyorlarsa derhal ba\u015fvurmalar\u0131n\u0131 talep ederek bildirimde bulunmaya karar verebilir.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>M\u00fclkte B\u0131rak\u0131lan Kirac\u0131 Demirba\u015flar\u0131 ve Donan\u0131mlar\u0131<\/strong>\u00a0<\/h3>\n\n\n\n<p>Kirac\u0131n\u0131n demirba\u015flar\u0131 ile ilgili olarak genel g\u00f6r\u00fc\u015f, kira s\u00f6zle\u015fmesinde \u00f6zel bir h\u00fck\u00fcm bulunmamas\u0131 halinde, kira s\u00f6zle\u015fmesinin bar\u0131\u015f\u00e7\u0131l bir \u015fekilde yeniden girilmesi ile kaybedilmesi durumunda, kirac\u0131n\u0131n demirba\u015flar\u0131 \u00e7\u0131karma hakk\u0131n\u0131n kayboldu\u011fu y\u00f6n\u00fcndedir.&nbsp;<\/p>\n\n\n\n<p>Menkul mallar s\u00f6z konusu oldu\u011funda, ev sahibinin muhtemelen g\u00f6n\u00fcls\u00fcz bir kefil olmas\u0131 ve \u00fc\u00e7\u00fcnc\u00fc tarafa 1977 tarihli Haks\u0131z Fiil (Mallara M\u00fcdahale) Yasas\u0131 uyar\u0131nca bildirimde bulunarak bunlar\u0131 tahsil etme f\u0131rsat\u0131 vermesi gerekecektir.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Tapu Sicilindeki Kay\u0131tlar\u0131n Kald\u0131r\u0131lmas\u0131<\/strong>\u00a0<\/h3>\n\n\n\n<p>Kira kontrat\u0131n\u0131n Tapu Sicilinde kay\u0131tl\u0131 olmas\u0131 halinde, ev sahibinin kira kontrat\u0131n\u0131 kapatmak ve kira kontrat\u0131yla ilgili kay\u0131tlar\u0131 \u00fcst tapulardan kald\u0131rmak i\u00e7in gerekli ad\u0131mlar\u0131 atmas\u0131 gerekebilir.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>El Koyma Sonras\u0131 \u0130\u015fletme Oranlar\u0131 Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<\/strong>\u00a0<\/h3>\n\n\n\n<p>Bir ev sahibinin kira s\u00f6zle\u015fmesini feshetmesi durumunda, ev sahibi bir kez daha zilyetlik hakk\u0131na sahip ki\u015fi olarak oranlar\u0131 \u00f6demekten sorumlu olacakt\u0131r (mevcut olabilecek herhangi bir indirime tabi olarak).&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Onar\u0131m S\u00f6zle\u015fmelerinin \u0130hlali i\u00e7in Kendi Kendine Yard\u0131m<\/strong>&nbsp;<\/h3>\n\n\n\n<p>Ticari bir kira s\u00f6zle\u015fmesinin s\u00fcresi boyunca kirac\u0131n\u0131n onar\u0131m taahh\u00fctlerini ihlal etmesi durumunda ev sahibinin alabilece\u011fi tazminat miktar\u0131na ili\u015fkin yasal s\u0131n\u0131rlamalar bulunmaktad\u0131r. Baz\u0131 durumlarda, kira s\u00f6zle\u015fmesi bunu \u00f6ng\u00f6r\u00fcyorsa ev sahipleri m\u00fclke girebilir ve i\u015fleri kendileri yapabilir (\u201cJervis v Harris\u201d maddesi olarak bilinir).&nbsp;<\/p>\n\n\n\n<p>Bu, ev sahipleri i\u00e7in yararl\u0131 bir ara\u00e7 olabilir, \u00e7\u00fcnk\u00fc i\u015flerin maliyetini kirac\u0131dan tazminat olarak de\u011fil, bor\u00e7 olarak geri alma hakk\u0131na sahiptirler.
