B\u00f6l\u00fcm\u00fc uyar\u0131nca, borcun muaccel hale gelmesinden itibaren 6 ay i\u00e7inde bu ki\u015fiye bir ihbarda bulunmas\u0131 gerekmektedir. Bir mahkeme duru\u015fmas\u0131 birka\u00e7 ay i\u00e7in belirlenmeyebilir ve kirac\u0131 bu s\u00fcre i\u00e7inde bor\u00e7lar\u0131n\u0131 \u00f6demek i\u00e7in herhangi bir itici g\u00fc\u00e7 hissetmeyebilir.<\/li>\n\n\n\n<li>Ev sahibi, kirac\u0131ya mali i\u015flerini d\u00fczene koymas\u0131 ve bor\u00e7lar\u0131n\u0131 \u00f6demesi i\u00e7in zaman vermek istiyorsa, ev sahibi ve kirac\u0131 ili\u015fkisini koruyarak, mahkeme i\u015flemleri \u00f6denmemi\u015f kiray\u0131 almak i\u00e7in harekete ge\u00e7menin en uygun yolu olabilir.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ticari Kira Bor\u00e7lar\u0131n\u0131n Geri Al\u0131nmas\u0131 (CRAR)<\/strong><\/h2>\n\n\n\n<p>Ticari kira bor\u00e7lar\u0131n\u0131n tahsili (CRAR), ticari m\u00fclklerle ilgili kira bor\u00e7lar\u0131n\u0131n tahsili i\u00e7in bir icra memurunun kirac\u0131n\u0131n mallar\u0131n\u0131n kontrol\u00fcn\u00fc ele ge\u00e7irmesine ve bor\u00e7lar\u0131 tahsil etmek i\u00e7in bunlar\u0131 satmas\u0131na olanak tan\u0131yan bir icra y\u00f6ntemidir. Bu y\u00f6ntem, 6 Nisan 2014 tarihinden itibaren ge\u00e7erli olmak \u00fczere, genel hukuktaki haciz hakk\u0131n\u0131 ortadan kald\u0131rm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Bir ev sahibinin CRAR kapsam\u0131nda kirac\u0131s\u0131ndan kiray\u0131 geri alma hakk\u0131 oldu\u011fu durumlarda, ev sahibinin alt kirac\u0131dan da kiray\u0131 geri alma hakk\u0131 vard\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>D\u00fc\u015f\u00fcnceler:<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>CRAR sadece anapara kira bor\u00e7lar\u0131na kar\u015f\u0131 kullan\u0131labilir. Gecikmi\u015f bor\u00e7lardan herhangi biri hizmet \u00fccretleri, sigorta kiras\u0131 veya kira s\u00f6zle\u015fmesi kapsam\u0131nda \u00f6denmesi gereken di\u011fer mebla\u011flarla ilgiliyse, CRAR bunlar\u0131 tahsil etmek i\u00e7in kullan\u0131lamaz.<\/li>\n\n\n\n<li>CRAR'\u0131 kullanabilmek i\u00e7in ev sahibinin 7 g\u00fcn \u00f6nceden icra bildiriminde bulunmas\u0131 gerekmektedir.
