{"id":2075,"date":"2024-02-20T14:00:17","date_gmt":"2024-02-20T14:00:17","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?page_id=2075"},"modified":"2024-03-05T17:11:43","modified_gmt":"2024-03-05T17:11:43","slug":"direito-de-compra","status":"publish","type":"page","link":"https:\/\/rfblegal.co.uk\/pt\/servicos\/direito-pessoal\/imoveis-residenciais\/direito-de-compra\/","title":{"rendered":"Right to Buy"},"content":{"rendered":"<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"font-style:normal;font-weight:600\">Right of First Refusal<\/h2>\n\n\n\n<h4 class=\"wp-block-heading has-lg-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);font-style:normal;font-weight:500\">We have a specialist team dealing with matters relating to the Landlord and Tenant Act 1987 which gives certain leaseholders a right of first refusal to buy the freehold or superior leasehold interest in their building in the event that the landlord decides to dispose of it.<\/h4>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">The Landlord and Tenant Act 1987 (\u2018the 1987 Act\u2019) gives a right of first refusal to \u201cqualifying tenants\u201d by prohibiting certain landlords from making certain disposals of certain premises without first offering the disposal to the \u201cqualifying tenants\u201d of the building.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">The 1987 Act applies to premises that are the whole, or part, of a building that contains two or more flats held by qualifying tenants, and more than half of the flats in the premises are held by qualifying tenants. The 1987 Act does not apply to buildings in which greater than 50% of the internal floor area is occupied for non-residential purposes.&nbsp;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">The definition of \u201cqualifying tenant\u201d in the 1987 Act includes leaseholders and most fixed or periodic tenancies but excludes shorthold or assured tenancies, business and agricultural tenancies, and tenancies that are dependent upon employment. A tenant who owns a tenancy of three or more flats in the building is also excluded from being a &#8220;qualifying tenant&#8221;.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">The 1987 Act is wide-ranging as it applies to &#8220;relevant disposals&#8221; which are disposals by the landlord of any estate or interest in the premises (including any estate or interest in the common parts).<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Assuming that the qualifying criteria are met, it is essential that the requirements of the 1987 Act are strictly followed.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">A landlord who does not comply with the requirements of the 1987 Act commits a criminal offence and could be subject to a fine on conviction.
