Em primeiro lugar, confirme a rece\u00e7\u00e3o da reclama\u00e7\u00e3o por escrito e marque uma inspe\u00e7\u00e3o ao im\u00f3vel o mais rapidamente poss\u00edvel. Se o estado de degrada\u00e7\u00e3o se enquadrar nas suas obriga\u00e7\u00f5es legais enquanto senhorio (por exemplo, ao abrigo da sec\u00e7\u00e3o 11 da Lei do Senhorio e do Inquilino de 1985), deve realizar as obras necess\u00e1rias num prazo razo\u00e1vel. Ignorar ou adiar as repara\u00e7\u00f5es pode agravar o problema e expor-lhe a a\u00e7\u00f5es judiciais.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>P: Entreguei ao meu inquilino uma notifica\u00e7\u00e3o de despejo, mas ele alega que o im\u00f3vel se encontra em mau estado \u2013 quais s\u00e3o os riscos?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Um inquilino pode invocar alega\u00e7\u00f5es de mau estado do im\u00f3vel para contestar ou atrasar os processos de despejo. Se conseguir demonstrar que o senhor n\u00e3o procedeu \u00e0s repara\u00e7\u00f5es necess\u00e1rias, o tribunal poder\u00e1 recusar a concess\u00e3o do despejo, ou o inquilino poder\u00e1 apresentar uma reconven\u00e7\u00e3o por danos. Em alguns casos, o mau estado de conserva\u00e7\u00e3o pode at\u00e9 invalidar uma notifica\u00e7\u00e3o, especialmente quando se aplicam prote\u00e7\u00f5es contra o despejo por retalia\u00e7\u00e3o (por exemplo, ao abrigo da Lei de Desregulamenta\u00e7\u00e3o de 2015 no que diz respeito a arrendamentos garantidos de curta dura\u00e7\u00e3o).&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>P: Com que rapidez devo resolver os problemas de degrada\u00e7\u00e3o?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>N\u00e3o existe um prazo legal fixo, mas a lei exige que os senhorios ajam num \u201cprazo razo\u00e1vel\u201d ap\u00f3s terem sido notificados. O que \u00e9 \u201crazo\u00e1vel\u201d depende da gravidade do problema. Por exemplo, uma caldeira avariada no inverno deve ser resolvida com urg\u00eancia, enquanto que pequenos problemas est\u00e9ticos podem permitir um prazo de resposta mais alargado. Em qualquer caso, quanto mais cedo agir, melhor ser\u00e1 a sua posi\u00e7\u00e3o jur\u00eddica.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>P: O meu inquilino entregou-me uma notifica\u00e7\u00e3o pr\u00e9via de a\u00e7\u00e3o judicial alegando mau estado de conserva\u00e7\u00e3o do im\u00f3vel \u2013 o que devo fazer?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Uma carta de pr\u00e9-a\u00e7\u00e3o significa, normalmente, que o inquilino est\u00e1 a ponderar intentar uma a\u00e7\u00e3o judicial. Deve:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Responda \u00e0 carta o mais rapidamente poss\u00edvel.<\/strong>&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Procure aconselhamento jur\u00eddico imediatamente<\/strong> \u2013 deve seguir o Protocolo Pr\u00e9-A\u00e7\u00e3o para Casos de Degrada\u00e7\u00e3o de Habita\u00e7\u00f5es.&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Inspecione o im\u00f3vel e mantenha registos detalhados<\/strong> (fotografias, relat\u00f3rios de inspe\u00e7\u00e3o, registos de repara\u00e7\u00f5es).&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Efetuar as repara\u00e7\u00f5es necess\u00e1rias<\/strong> sem demora.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>A falta de uma resposta adequada pode aumentar o risco de um processo judicial e de lhe serem atribu\u00eddos custos adicionais.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>P: Que problemas num im\u00f3vel s\u00e3o considerados estado de degrada\u00e7\u00e3o?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>O conceito de degrada\u00e7\u00e3o abrange, em geral, a deteriora\u00e7\u00e3o em rela\u00e7\u00e3o ao estado original do im\u00f3vel.
