Para os empregadores que t\u00eam pessoal a tempo parcial, trabalhadores tempor\u00e1rios, contratos de zero horas, pessoal sazonal, trabalhadores por turnos, pagamentos de comiss\u00f5es ou horas extraordin\u00e1rias regulares, as regras podem ser particularmente dif\u00edceis de aplicar na pr\u00e1tica.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para os empregadores, n\u00e3o se trata apenas de uma quest\u00e3o relacionada com a folha de pagamentos. As recentes reformas relativas ao subs\u00eddio de f\u00e9rias introduziram regras espec\u00edficas para hor\u00e1rios irregulares e trabalhadores a tempo parcial, incluindo a op\u00e7\u00e3o de utilizar o subs\u00eddio de f\u00e9rias acumulado em circunst\u00e2ncias limitadas. A partir de 6 de abril de 2026, os empregadores ter\u00e3o tamb\u00e9m de conservar os registos relativos \u00e0s f\u00e9rias anuais e ao subs\u00eddio de f\u00e9rias durante, pelo menos, seis anos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Este artigo aborda as principais quest\u00f5es que os empregadores devem ter em conta na gest\u00e3o do pagamento de f\u00e9rias, dos trabalhadores com hor\u00e1rios irregulares e da manuten\u00e7\u00e3o de registos de f\u00e9rias.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quais s\u00e3o as regras b\u00e1sicas relativas ao pagamento de f\u00e9rias?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A maioria dos trabalhadores tem direito a 5,6 semanas de f\u00e9rias pagas por ano. Isto inclui trabalhadores a tempo inteiro, a tempo parcial, tempor\u00e1rios, ocasionais e com contratos de zero horas, desde que tenham o estatuto de trabalhador para efeitos da legisla\u00e7\u00e3o laboral.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O subs\u00eddio de f\u00e9rias deve, normalmente, corresponder ao sal\u00e1rio normal do trabalhador. No caso dos funcion\u00e1rios com hor\u00e1rio e remunera\u00e7\u00e3o fixos, isto \u00e9 frequentemente simples. No entanto, para os funcion\u00e1rios e trabalhadores cuja remunera\u00e7\u00e3o varia devido a turnos, horas extraordin\u00e1rias, comiss\u00f5es, b\u00f3nus, subs\u00eddios ou hor\u00e1rios de trabalho irregulares, o c\u00e1lculo pode ser mais complexo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem, por isso, evitar partir do princ\u00edpio de que o sal\u00e1rio base ou a remunera\u00e7\u00e3o hor\u00e1ria s\u00e3o sempre suficientes. Dependendo das circunst\u00e2ncias, a remunera\u00e7\u00e3o de f\u00e9rias poder\u00e1 ter de incluir pagamentos relacionados com o desempenho de tarefas contratuais, horas extraordin\u00e1rias regulares, comiss\u00f5es ou outros pagamentos que fa\u00e7am parte da remunera\u00e7\u00e3o normal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na pr\u00e1tica, para os empregadores, o pagamento das f\u00e9rias n\u00e3o deve ser tratado como uma simples tarefa administrativa relacionada com as f\u00e9rias anuais. Deve ser verificado em rela\u00e7\u00e3o aos contratos, aos dados da folha de pagamentos e \u00e0 forma como os trabalhadores realmente trabalham.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Por que raz\u00e3o os empregadores devem levar a s\u00e9rio o cumprimento das regras relativas ao pagamento de f\u00e9rias?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Existem v\u00e1rias raz\u00f5es pelas quais os empregadores devem levar a s\u00e9rio o cumprimento das regras relativas ao pagamento de f\u00e9rias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em primeiro lugar, existe o risco jur\u00eddico. Os trabalhadores podem apresentar reclama\u00e7\u00f5es por dedu\u00e7\u00f5es ilegais dos sal\u00e1rios nos casos em que o subs\u00eddio de f\u00e9rias tenha sido pago em montante inferior ao devido. Estas reclama\u00e7\u00f5es podem dizer respeito a pagamentos em falta relativos a per\u00edodos anteriores e podem afetar grupos de trabalhadores nos quais tenha sido utilizado o mesmo m\u00e9todo de c\u00e1lculo em toda a empresa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em segundo lugar, h\u00e1 o risco relacionado com a folha de pagamentos. Isto \u00e9 particularmente comum em empresas que recorrem a pessoal tempor\u00e1rio, hor\u00e1rios vari\u00e1veis, comiss\u00f5es, horas extraordin\u00e1rias ou trabalhadores sazonais, o que pode complicar o c\u00e1lculo das f\u00e9rias pagas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em terceiro lugar, h\u00e1 o risco relacionado com a manuten\u00e7\u00e3o de registos. A partir de 6 de abril de 2026, os empregadores devem conservar os registos relativos \u00e0s f\u00e9rias anuais e ao subs\u00eddio de f\u00e9rias durante, pelo menos, seis anos. Isto significa que os empregadores t\u00eam de poder comprovar n\u00e3o s\u00f3 que os trabalhadores receberam o direito a f\u00e9rias a que tinham direito, mas tamb\u00e9m que o subs\u00eddio de f\u00e9rias foi calculado e registado de forma adequada.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A quest\u00e3o pr\u00e1tica \u00e9 simples: os empregadores n\u00e3o devem esperar que seja apresentada uma queixa ou reclama\u00e7\u00e3o para verificar se as suas disposi\u00e7\u00f5es relativas ao pagamento de f\u00e9rias est\u00e3o em conformidade.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trabalhadores com hor\u00e1rios irregulares e trabalhadores sazonais<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As regras relativas aos hor\u00e1rios irregulares e aos trabalhadores sazonais t\u00eam constitu\u00eddo uma fonte de dificuldade particular para os empregadores, especialmente no que diz respeito ao c\u00e1lculo das f\u00e9rias pagas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Um trabalhador com hor\u00e1rio irregular \u00e9, em termos gerais, algu\u00e9m cujas horas remuneradas s\u00e3o total ou maioritariamente vari\u00e1veis, nos termos do seu contrato, em cada per\u00edodo de pagamento. Um trabalhador sazonal \u00e9, em termos gerais, algu\u00e9m que \u00e9 obrigado a trabalhar apenas parte do ano e que tem per\u00edodos de, pelo menos, uma semana durante os quais n\u00e3o \u00e9 obrigado a trabalhar e n\u00e3o recebe remunera\u00e7\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para os anos de f\u00e9rias com in\u00edcio a partir de 1 de abril de 2024, os trabalhadores com hor\u00e1rios irregulares e os trabalhadores a tempo parcial acumulam o direito a f\u00e9rias legais \u00e0 medida que trabalham. A taxa de acumula\u00e7\u00e3o legal habitual \u00e9 de 12,071 TP3T de horas trabalhadas num per\u00edodo de remunera\u00e7\u00e3o, com base no direito m\u00ednimo legal de 5,6 semanas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Isto pode ser \u00fatil para empregadores com pessoal tempor\u00e1rio, sazonal ou com hor\u00e1rios vari\u00e1veis. No entanto, tamb\u00e9m coloca alguns desafios pr\u00e1ticos. Os empregadores precisam de registos precisos das horas trabalhadas, das f\u00e9rias acumuladas, das f\u00e9rias gozadas, das f\u00e9rias transitadas e do pagamento de f\u00e9rias efetuado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem tamb\u00e9m verificar se os contratos e os sistemas de processamento salarial foram atualizados. Os contratos mais antigos podem n\u00e3o refletir as regras atuais e podem criar confus\u00e3o quanto aos direitos, ao ac\u00famulo de direitos e ao pagamento.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Remunera\u00e7\u00e3o de f\u00e9rias acumulada<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O pagamento acumulado de f\u00e9rias consiste em distribuir o valor das f\u00e9rias ao longo do ano, adicionando um montante adicional ao sal\u00e1rio do trabalhador, em vez de pagar as f\u00e9rias quando estas s\u00e3o efetivamente gozadas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores podem agora optar por utilizar o pagamento acumulado de f\u00e9rias apenas para os trabalhadores com hor\u00e1rios irregulares e para os trabalhadores a tempo parcial. Quando for utilizado, deve, em regra, ser calculado a uma taxa de, pelo menos, 12,071% do sal\u00e1rio total do trabalhador no per\u00edodo de remunera\u00e7\u00e3o em causa e indicado separadamente no recibo de vencimento.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Esta medida pode ser atraente para os empregadores que contratam trabalhadores tempor\u00e1rios ou com hor\u00e1rios vari\u00e1veis, mas n\u00e3o deve ser adotada sem reflex\u00e3o. Os empregadores continuam a ter a responsabilidade legal de garantir que os trabalhadores gozem as f\u00e9rias a que t\u00eam direito. Existe o risco de que o pagamento acumulado das f\u00e9rias possa desencorajar os trabalhadores de gozar as f\u00e9rias, caso n\u00e3o recebam o pagamento quando realmente tiram os dias de folga.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Antes de introduzir o pagamento acumulado de f\u00e9rias, os empregadores devem ponderar se s\u00e3o necess\u00e1rias altera\u00e7\u00f5es aos contratos, se os trabalhadores foram devidamente informados, se o sistema de processamento salarial permite apresentar esse pagamento separadamente e se os gestores compreendem que as f\u00e9rias continuam a ter de ser gozadas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Subs\u00eddio de f\u00e9rias e remunera\u00e7\u00e3o normal<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Os erros no pagamento das f\u00e9rias surgem frequentemente porque os empregadores n\u00e3o identificam corretamente o que deve ser inclu\u00eddo no sal\u00e1rio normal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dependendo das circunst\u00e2ncias, o subs\u00eddio de f\u00e9rias poder\u00e1 ter de incluir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pagamentos regulares de horas extraordin\u00e1rias;<\/li>\n\n\n\n<li>pagamentos de comiss\u00f5es;<\/li>\n\n\n\n<li>pagamentos relacionados com obriga\u00e7\u00f5es contratuais;<\/li>\n\n\n\n<li>subs\u00eddios por turnos;<\/li>\n\n\n\n<li>pagamentos relacionados com a situa\u00e7\u00e3o profissional ou pessoal, tais como antiguidade ou qualifica\u00e7\u00f5es;<\/li>\n\n\n\n<li>outros pagamentos regulares que fazem parte do sal\u00e1rio normal.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem ter especial cuidado nos casos em que os trabalhadores recebem remunera\u00e7\u00e3o vari\u00e1vel, a fim de garantir o cumprimento das regras relativas ao c\u00e1lculo do subs\u00eddio de f\u00e9rias. Um sistema de processamento salarial que calcule o subs\u00eddio de f\u00e9rias com base apenas no sal\u00e1rio base pode estar incorreto se o trabalhador receber regularmente horas extraordin\u00e1rias, comiss\u00f5es ou outros pagamentos que devam ser tidos em conta no c\u00e1lculo do subs\u00eddio de f\u00e9rias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Esta \u00e9 uma \u00e1rea em que pequenos erros podem sair caros se se repetirem ao longo do tempo ou entre os colaboradores.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Manuten\u00e7\u00e3o de registos a partir de 6 de abril de 2026<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A partir de 6 de abril de 2026, os empregadores devem manter registos das f\u00e9rias anuais e do subs\u00eddio de f\u00e9rias. Os registos devem incluir as f\u00e9rias gozadas, as f\u00e9rias transitadas de anos anteriores, o subs\u00eddio de f\u00e9rias e quaisquer pagamentos em substitui\u00e7\u00e3o de f\u00e9rias, tais como pagamentos relativos a f\u00e9rias n\u00e3o gozadas quando um trabalhador cessa a rela\u00e7\u00e3o de trabalho.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No que diz respeito aos registos relativos ao subs\u00eddio de f\u00e9rias, os empregadores devem poder comprovar o que foi inclu\u00eddo no c\u00e1lculo, como comiss\u00f5es, b\u00f3nus, horas extraordin\u00e1rias ou outros pagamentos relevantes. Os registos devem ser conservados durante, pelo menos, seis anos a contar da data em que foram elaborados.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores podem manter os registos num formato que considerem adequado. Isso pode incluir um sistema de recursos humanos, um sistema de processamento de sal\u00e1rios, uma folha de c\u00e1lculo ou outro sistema de gest\u00e3o. O que importa \u00e9 que os registos sejam precisos, completos e capazes de comprovar o cumprimento das normas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem tamb\u00e9m assegurar que os registos relativos \u00e0s f\u00e9rias s\u00e3o mantidos em conformidade com o RGPD do Reino Unido e com os requisitos de prote\u00e7\u00e3o de dados.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Problemas comuns relacionados com o pagamento de f\u00e9rias para os empregadores<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As quest\u00f5es relacionadas com o subs\u00eddio de f\u00e9rias surgem frequentemente de forma gradual, em vez de resultarem de um \u00fanico erro evidente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Entre os problemas mais comuns contam-se:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>trabalhadores tempor\u00e1rios que acumulam f\u00e9rias, mas raramente as tiram;<\/li>\n\n\n\n<li>trabalhadores com contratos de zero horas cujos direitos n\u00e3o s\u00e3o devidamente registados;<\/li>\n\n\n\n<li>trabalhadores a tempo parcial cujos contratos n\u00e3o foram atualizados;<\/li>\n\n\n\n<li>funcion\u00e1rios com horas extraordin\u00e1rias regulares que n\u00e3o s\u00e3o tidas em conta no c\u00e1lculo do subs\u00eddio de f\u00e9rias;<\/li>\n\n\n\n<li>funcion\u00e1rios remunerados \u00e0 comiss\u00e3o cujo subs\u00eddio de f\u00e9rias \u00e9 calculado apenas com base no sal\u00e1rio base;<\/li>\n\n\n\n<li>trabalhadores que deixam o emprego sem receberem o pagamento devido pelas f\u00e9rias acumuladas mas n\u00e3o gozadas;<\/li>\n\n\n\n<li>tratamento inconsistente entre departamentos ou gestores;<\/li>\n\n\n\n<li>registos incompletos das f\u00e9rias acumuladas;<\/li>\n\n\n\n<li>sistemas de processamento salarial que n\u00e3o correspondem aos acordos contratuais.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">No caso das PME, estas quest\u00f5es surgem frequentemente porque a gest\u00e3o das f\u00e9rias \u00e9 repartida entre os departamentos de recursos humanos, de contabilidade salarial, financeiro e os gestores de linha, sem que haja uma \u00fanica pessoa respons\u00e1vel por supervisionar todo o processo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pol\u00edticas, contratos e sistemas de processamento salarial<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem garantir que os contratos, as pol\u00edticas e os sistemas de processamento salarial estejam todos em conformidade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Isso pode implicar a revis\u00e3o de contratos de trabalho, acordos com trabalhadores tempor\u00e1rios, manuais do pessoal, pol\u00edticas relativas \u00e0s f\u00e9rias anuais, configura\u00e7\u00f5es da folha de pagamentos, reda\u00e7\u00e3o dos recibos de vencimento e procedimentos relativos \u00e0 sa\u00edda de funcion\u00e1rios.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem verificar se os documentos explicam:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>o per\u00edodo festivo;<\/li>\n\n\n\n<li>direito a f\u00e9rias anuais;<\/li>\n\n\n\n<li>como se acumulam os dias de f\u00e9rias;<\/li>\n\n\n\n<li>como se deve solicitar f\u00e9rias;<\/li>\n\n\n\n<li>regras relativas ao reporte de f\u00e9rias;<\/li>\n\n\n\n<li>como \u00e9 calculado o subs\u00eddio de f\u00e9rias;<\/li>\n\n\n\n<li>se \u00e9 utilizado o pagamento acumulado de f\u00e9rias;<\/li>\n\n\n\n<li>o que acontece quando o contrato de trabalho termina;<\/li>\n\n\n\n<li>quem \u00e9 respons\u00e1vel pela manuten\u00e7\u00e3o dos registos.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Uma pol\u00edtica juridicamente correta \u00e9 \u00fatil, mas n\u00e3o resolver\u00e1 o problema se os gestores e as equipas de recursos humanos n\u00e3o souberem como aplic\u00e1-la na pr\u00e1tica.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Erros comuns cometidos pelos empregadores<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem ter especial cuidado para evitar os seguintes erros:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>partindo do princ\u00edpio de que o subs\u00eddio de f\u00e9rias se baseia sempre apenas no sal\u00e1rio base;<\/li>\n\n\n\n<li>n\u00e3o incluir horas extraordin\u00e1rias regulares, comiss\u00f5es ou outros pagamentos relevantes;<\/li>\n\n\n\n<li>atrav\u00e9s da acumula\u00e7\u00e3o do subs\u00eddio de f\u00e9rias para os trabalhadores que n\u00e3o tenham hor\u00e1rios irregulares nem sejam trabalhadores sazonais;<\/li>\n\n\n\n<li>n\u00e3o indicar separadamente o subs\u00eddio de f\u00e9rias acumulado nos recibos de vencimento;<\/li>\n\n\n\n<li>n\u00e3o incentivar os trabalhadores a gozar f\u00e9rias;<\/li>\n\n\n\n<li>n\u00e3o manter registos adequados das f\u00e9rias gozadas e transitadas;<\/li>\n\n\n\n<li>n\u00e3o ter mantido registos relativos ao subs\u00eddio de f\u00e9rias durante seis anos;<\/li>\n\n\n\n<li>utilizar contratos ou pol\u00edticas de f\u00e9rias desatualizados;<\/li>\n\n\n\n<li>n\u00e3o calcular corretamente as f\u00e9rias quando algu\u00e9m se despede;<\/li>\n\n\n\n<li>confiar num software de gest\u00e3o de sal\u00e1rios sem verificar os pressupostos legais subjacentes;<\/li>\n\n\n\n<li>tratar os trabalhadores tempor\u00e1rios ou com contratos de zero horas como se n\u00e3o tivessem direito a f\u00e9rias.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Muitos lit\u00edgios relativos ao pagamento de f\u00e9rias surgem n\u00e3o porque o empregador tencionasse pagar menos aos trabalhadores, mas porque as regras foram mal interpretadas ou os sistemas n\u00e3o foram devidamente atualizados.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Medidas pr\u00e1ticas para os empregadores<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Os empregadores devem considerar a ado\u00e7\u00e3o das seguintes medidas neste momento:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Analisar as atuais horas.<\/li>\n\n\n\n<li>Verifique se as horas extraordin\u00e1rias, as comiss\u00f5es ou os subs\u00eddios est\u00e3o inclu\u00eddos, quando aplic\u00e1vel.<\/li>\n\n\n\n<li>Verifique se o pagamento
