{"id":7402,"date":"2025-10-22T11:53:29","date_gmt":"2025-10-22T11:53:29","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=7402"},"modified":"2025-10-22T11:57:43","modified_gmt":"2025-10-22T11:57:43","slug":"vitoria-no-tribunal-de-recurso-em-materia-de-emprego","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/pt\/percepcoes\/vitoria-no-tribunal-de-recurso-em-materia-de-emprego\/","title":{"rendered":"Vit\u00f3ria no Tribunal de Recurso do Trabalho"},"content":{"rendered":"<p>A equipa de Direito do Trabalho da RFB obteve uma vit\u00f3ria significativa no Employment Appeal Tribunal (\u2018EAT\u2019), recorrendo com sucesso de um caso que refor\u00e7a a import\u00e2ncia de uma avalia\u00e7\u00e3o justa e fundamentada nos pedidos de despedimento. <\/p>\n\n\n\n<p>Em outubro de 2023, o Departamento de Emprego representou com sucesso Jacqueline Davidson, uma motorista de PCV, no seu pedido de despedimento sem justa causa contra a National Express Limited. A Sr.\u00aa Davidson falhou um teste de baf\u00f3metro no local de trabalho devido ao uso de elixir bucal \u00e0 base de \u00e1lcool, registando um valor superior ao limite estabelecido pela empresa, mas ainda assim tr\u00eas vezes&nbsp;<strong><u>abaixo<\/u><\/strong>&nbsp;o limite nacional de condu\u00e7\u00e3o sob o efeito do \u00e1lcool.  O limite nacional de condu\u00e7\u00e3o sob o efeito do \u00e1lcool para os condutores em Inglaterra, no Pa\u00eds de Gales e na Irlanda do Norte \u00e9 de 3,5 no baf\u00f3metro. As leituras do baf\u00f3metro de Davidson foram de 1,3, depois de 1,0 e, finalmente, de 0,8 em tr\u00eas tentativas sucessivas efectuadas num curto espa\u00e7o de tempo. Depois de n\u00e3o ter passado no teste, a National Express Limited permitiu que Davidson conduzisse at\u00e9 casa e mais tarde despediu-a.<\/p>\n\n\n\n<p>O London East Employment Tribunal (o \u2018Tribunal\u2019) considerou o despedimento injusto com base no facto de o procedimento adotado na fase de recurso ter sido incorreto e elevou a sua indemniza\u00e7\u00e3o em 10% por incumprimento do C\u00f3digo ACAS. No entanto, o Tribunal aplicou uma redu\u00e7\u00e3o de 75% por Polkey e comportamento contributivo.<\/p>\n\n\n\n<p>O departamento de emprego da RFB recorreu para o EAT, contestando a redu\u00e7\u00e3o significativa da indemniza\u00e7\u00e3o, a falta de fundamenta\u00e7\u00e3o para limitar a indemniza\u00e7\u00e3o aos 65 anos, uma vez que, segundo a Sra. Davidson, ela se teria reformado aos 70 anos. A Sra. Davidson tamb\u00e9m recorreu da decis\u00e3o de despedimento sem justa causa.<\/p>\n\n\n\n<p>O EAT considerou que o Tribunal cometeu um erro na avalia\u00e7\u00e3o dos preju\u00edzos, para efeitos da indemniza\u00e7\u00e3o. O Tribunal limitou o c\u00e1lculo subjacente da perda de rendimentos futuros ao per\u00edodo at\u00e9 \u00e0 idade de 65 anos, considerando-o justo e equitativo em todas as circunst\u00e2ncias. No entanto, o EAT considerou que o Tribunal devia, na medida do poss\u00edvel, avaliar o preju\u00edzo futuro sofrido por M. Davidson em consequ\u00eancia do despedimento e imput\u00e1vel \u00e0s ac\u00e7\u00f5es da National Express Limited. O EAT observou igualmente que o Tribunal n\u00e3o teve em conta a posi\u00e7\u00e3o de M. Davidson de que teria de trabalhar at\u00e9 aos 70 anos de idade.<\/p>\n\n\n\n<p>A quest\u00e3o foi agora remetida para o Employment Tribunal para nova aprecia\u00e7\u00e3o.<\/p>\n\n\n\n<p>Esta decis\u00e3o \u00e9 uma importante chamada de aten\u00e7\u00e3o para o facto de os Tribunais serem obrigados a avaliar o per\u00edodo de perda por refer\u00eancia a todos os elementos de prova de que disp\u00f5em e n\u00e3o poderem simplesmente optar pela idade da reforma sem justifica\u00e7\u00e3o.<\/p>\n\n\n\n<p>Parab\u00e9ns a Michael Michaeloudis e Tariro Carmel Nyoka, que representaram o requerente com Saul Margo da Outer Temple Chambers.<\/p>\n\n\n\n<p><\/p>","protected":false},"author":12,"featured_media":7403,"parent":0,"menu_order":0,"template":"","format":"standard","meta":{"_acf_changed":false,"om_disable_all_campaigns":false,"_uf_show_specific_survey":0,"_uf_disable_surveys":false,"footnotes":""},"categories":[67],"tags":[],"class_list":["post-7402","insight","type-insight","status-publish","format-standard","has-post-thumbnail","hentry","category-employment"],"acf":[],"aioseo_notices":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
