Em julho de 2025, seis grandes propriet\u00e1rios e funda\u00e7\u00f5es de caridade interpuseram um recurso de revis\u00e3o judicial. O resultado determinar\u00e1 se os pilares centrais da reforma do regime de arrendamento permanecer\u00e3o intactos ou ser\u00e3o restringidos precisamente no momento em que deveriam entrar em vigor.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Por que raz\u00e3o era necess\u00e1ria uma reforma do regime de arrendamento&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O regime de arrendamento com op\u00e7\u00e3o de compra tem sido, desde h\u00e1 muito, alvo de controv\u00e9rsia. Os arrendat\u00e1rios s\u00e3o propriet\u00e1rios das suas casas por um per\u00edodo determinado, mas continuam obrigados a pagar uma renda fundi\u00e1ria e despesas de condom\u00ednio, e t\u00eam de lidar com regras complexas caso pretendam prolongar o contrato de arrendamento ou adquirir a propriedade plena. Os cr\u00edticos argumentavam que o sistema favorecia desproporcionalmente os senhorios, especialmente em zonas urbanas de elevado valor, onde os pr\u00e9mios podiam ser muito elevados.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Um dos elementos mais controversos foi o valor de \u201cmarriage\u201d \u2014 um montante adicional a pagar quando o prazo do arrendamento fica abaixo dos 80 anos, refletindo a \u00abuni\u00e3o\u00bb entre o valor da propriedade plena e o valor do arrendamento. Os arrendat\u00e1rios argumentaram que se tratava de um ganho inesperado e injusto para os senhorios. Os propriet\u00e1rios, por sua vez, viram nisso o reconhecimento de um interesse financeiro genu\u00edno.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os apelos \u00e0 reforma intensificaram-se depois de a trag\u00e9dia de Grenfell ter revelado falhas na prote\u00e7\u00e3o dos arrendat\u00e1rios e de o p\u00fablico em geral ter tomado consci\u00eancia do aumento das despesas de condom\u00ednio. As comiss\u00f5es parlamentares instaram repetidamente a uma reforma abrangente, que culminou na Lei de 2024.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Principais disposi\u00e7\u00f5es da Lei de Reforma do Regime de Arrendamento e Propriedade de 2024&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A lei visava resolver tr\u00eas quest\u00f5es estruturais: avalia\u00e7\u00e3o, dura\u00e7\u00e3o e custos.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Avalia\u00e7\u00e3o&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A aboli\u00e7\u00e3o do valor do casamento;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A renda do terreno deve ser considerada com base num limite m\u00e1ximo (0,11% do valor de posse livre do im\u00f3vel) no c\u00e1lculo dos pr\u00e9mios;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As novas taxas prescritas ser\u00e3o definidas por legisla\u00e7\u00e3o secund\u00e1ria, com o objetivo de tornar as avalia\u00e7\u00f5es mais previs\u00edveis e mais econ\u00f3micas para os arrendat\u00e1rios.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2. Dura\u00e7\u00e3o do contrato de arrendamento&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Os direitos de arrendamento de apartamentos e moradias foram prolongados para 990 anos.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3. Custos&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Regra geral segundo a qual cada parte suporta as suas pr\u00f3prias despesas n\u00e3o judiciais em a\u00e7\u00f5es relativas \u00e0 aquisi\u00e7\u00e3o do direito de propriedade e \u00e0 prorroga\u00e7\u00e3o de contratos de arrendamento, com exce\u00e7\u00f5es muito limitadas;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Altera\u00e7\u00f5es ao \u2019Direito de Gest\u00e3o\u00bb para limitar a recupera\u00e7\u00e3o dos custos dos senhorios junto dos arrendat\u00e1rios.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">4. Outras reformas&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Simplifica\u00e7\u00e3o dos crit\u00e9rios de elegibilidade para o direito de gest\u00e3o;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Disposi\u00e7\u00f5es relativas \u00e0 transpar\u00eancia dos encargos de gest\u00e3o patrimonial;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Supress\u00e3o do requisito de dois anos de propriedade para o exerc\u00edcio dos direitos legais.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Algumas medidas, como a supress\u00e3o da regra dos dois anos de propriedade (em vigor desde janeiro de 2025), j\u00e1 entraram em vigor. Outras, incluindo o prazo de 990 anos e as novas taxas de avalia\u00e7\u00e3o, aguardam a aprova\u00e7\u00e3o de legisla\u00e7\u00e3o de execu\u00e7\u00e3o.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A revis\u00e3o judicial&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Em julho de 2025, o Tribunal Divisional (Holgate LJ e Foxton J) apreciou um processo de revis\u00e3o judicial com a dura\u00e7\u00e3o de quatro dias, interposto por seis requerentes: The Cadogan Estate, The Grosvenor Estate, Long Harbour, Albanwise Wallace, John Lyon\u2019s Charity e The Portal Trust. Em conjunto, controlam ou gerem cerca de 390 000 direitos de arrendamento. A sua contesta\u00e7\u00e3o visa diretamente as reformas de avalia\u00e7\u00e3o.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Os argumentos dos propriet\u00e1rios&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Os requerentes alegam que:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O valor do casamento \u00e9 um direito de propriedade protegido pelo artigo 1.\u00ba do Protocolo n.\u00ba 1 da Conven\u00e7\u00e3o Europeia dos Direitos Humanos. A sua supress\u00e3o constitui uma priva\u00e7\u00e3o ilegal de propriedade.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O limite m\u00e1ximo da renda fundi\u00e1ria priva-os injustamente do verdadeiro valor econ\u00f3mico dos seus bens.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O novo regime de custos impede-os de recuperar despesas leg\u00edtimas, interferindo mais uma vez nos direitos de propriedade.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Em termos gerais, as reformas s\u00e3o desproporcionadas, causando preju\u00edzos que se ascendem a centenas de milh\u00f5es de libras, sem conseguir estabelecer um equil\u00edbrio justo entre o interesse p\u00fablico e os direitos privados.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">A defesa do Governo&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O Secret\u00e1rio de Estado defende as reformas como uma medida leg\u00edtima de pol\u00edtica social destinada a corrigir d\u00e9cadas de desequil\u00edbrio. O Parlamento, argumenta, tem o direito de legislar no sentido de garantir a acessibilidade e a equidade no mercado imobili\u00e1rio. O governo sustenta ainda que o valor do casamento n\u00e3o constitui, por si s\u00f3, um \u201cbem\u201d para efeitos da CEDH, mas sim um conceito jur\u00eddico pass\u00edvel de reforma.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que aconteceu na audi\u00eancia?&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Relatos do tribunal sugerem que os ju\u00edzes se mostraram c\u00e9ticos em rela\u00e7\u00e3o \u00e0 ideia do \u00abvalor do casamento\u00bb como um direito de propriedade. Questionaram tamb\u00e9m se as perdas financeiras alegadas pelos propriet\u00e1rios, embora significativas, superavam o interesse p\u00fablico na reforma. O ac\u00f3rd\u00e3o foi reservado, estando a decis\u00e3o prevista para o final de 2025.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9 de salientar que os pedidos de interven\u00e7\u00e3o apresentados por grupos de defesa dos arrendat\u00e1rios foram recusados no in\u00edcio deste ano. Os cr\u00edticos argumentam que esta situa\u00e7\u00e3o deixou os arrendat\u00e1rios, precisamente as pessoas que deveriam beneficiar com a medida, sem uma voz direta no processo.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Reforma adiada&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Alguns elementos da LAFRA j\u00e1 entraram em vigor. Os arrendat\u00e1rios j\u00e1 n\u00e3o precisam de esperar dois anos antes de solicitar uma prorroga\u00e7\u00e3o do contrato de arrendamento, e os crit\u00e9rios de elegibilidade para o Direito de Gest\u00e3o foram alargados.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No entanto, outras reformas marcantes continuam suspensas. As prorroga\u00e7\u00f5es previstas dos contratos de arrendamento por 990 anos e os novos controlos sobre as despesas de gest\u00e3o imobili\u00e1ria dependem de legisla\u00e7\u00e3o derivada. Estas medidas encontram-se agora adiadas enquanto decorre o processo de revis\u00e3o judicial.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para muitos arrendat\u00e1rios, a incerteza \u00e9 grande. Um inqu\u00e9rito recente da Opinium, divulgado pelo The Times em julho de 2025, revelou que quase 60% dos arrendat\u00e1rios estavam com dificuldades em vender as suas casas, enquanto cerca de tr\u00eas quartos viram as suas despesas de condom\u00ednio aumentarem ao longo do \u00faltimo ano. A falta de clareza sobre a reforma deixou as fam\u00edlias a enfrentar dificuldades financeiras e pr\u00e1ticas.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que acontece a seguir?&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A decis\u00e3o ainda pendente determinar\u00e1 se as disposi\u00e7\u00f5es mais importantes da LFRA 2024 se mant\u00eam inalteradas. S\u00e3o poss\u00edveis tr\u00eas resultados gerais:&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Reformas confirmadas na \u00edntegra&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Os arrendat\u00e1rios beneficiam de prorroga\u00e7\u00f5es de arrendamento mais baratas e de maior dura\u00e7\u00e3o, com custos reduzidos.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Os propriet\u00e1rios perdem o valor de mercado e passam a estar sujeitos a uma redu\u00e7\u00e3o na renda fundi\u00e1ria.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2. Sucesso parcial para os propriet\u00e1rios&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O tribunal pode deferir algumas impugna\u00e7\u00f5es (por exemplo, relativas \u00e0 recupera\u00e7\u00e3o de custas) e, ao mesmo tempo, manter outras.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3.
