{"id":5696,"date":"2025-01-31T10:56:58","date_gmt":"2025-01-31T10:56:58","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=5696"},"modified":"2025-04-29T13:29:18","modified_gmt":"2025-04-29T13:29:18","slug":"atualizacoes-e-desafios-relativos-a-reforma-da-aquisicao-coletiva-de-direitos-de-arrendamento","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/pt\/percepcoes\/atualizacoes-e-desafios-relativos-a-reforma-da-aquisicao-coletiva-de-direitos-de-arrendamento\/","title":{"rendered":"Actualiza\u00e7\u00f5es e desafios da reforma da prorroga\u00e7\u00e3o do contrato de arrendamento e do direito de propriedade colectiva"},"content":{"rendered":"<h2 class=\"wp-block-heading\"><strong>A aboli\u00e7\u00e3o da regra dos dois anos<\/strong>\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O falecimento de <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2024\/22#:~:text=An%20Act%20to%20prohibit%20the,manage%20the%20buildings%20containing%20their\">Lei de Reforma do Regime de Arrendamento e da Propriedade de 2024 (LFRA 2024)<\/a> foi vista como um ponto de partida para a t\u00e3o esperada reforma nas \u00e1reas da prorroga\u00e7\u00e3o de contratos de arrendamento, da aquisi\u00e7\u00e3o coletiva da propriedade e do direito de gest\u00e3o. \u00c9 justo dizer que as reformas propostas eram, na sua grande maioria, favor\u00e1veis aos inquilinos, sendo alguns dos pontos-chave:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Eliminar o requisito de posse de dois anos para que o arrendat\u00e1rio possa dar in\u00edcio ao processo;\u00a0<\/li>\n\n\n\n<li>Aumentar o prazo de validade obrigat\u00f3rio de 90 anos para uns impressionantes 990 anos;\u00a0<\/li>\n\n\n\n<li>Eliminar a obriga\u00e7\u00e3o de o arrendat\u00e1rio pagar o \u2018valor de casamento\u2019;\u00a0<\/li>\n\n\n\n<li>Eliminar a possibilidade de o senhorio recuperar os seus custos junto do arrendat\u00e1rio na maioria dos casos.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">No entanto, a LFRA 2024 n\u00e3o indicou uma data de entrada em vigor nem apresentou c\u00e1lculos sobre o funcionamento de um eventual novo regime, o que levou \u00e0 necessidade de legisla\u00e7\u00e3o derivada para concretizar as altera\u00e7\u00f5es propostas.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Havia, no entanto, rumores de que essas reformas favor\u00e1veis aos inquilinos seriam contestadas por grandes grupos de senhorios, por serem potencialmente contr\u00e1rias aos seus direitos, uma vez que a elimina\u00e7\u00e3o dos pagamentos pelo \u00abvalor de casamento\u00bb poderia fazer desaparecer milh\u00f5es de libras do mercado imobili\u00e1rio sem qualquer compensa\u00e7\u00e3o.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No discurso do Rei, o Partido Trabalhista confirmou que algumas das altera\u00e7\u00f5es propostas exigiriam mais tempo para serem analisadas, mas que algumas das medidas mais f\u00e1ceis de implementar poderiam ser tratadas num prazo mais curto.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para esse efeito, foi agora aprovado o primeiro regulamento inicial que visa eliminar efetivamente o requisito de dois anos de propriedade a partir de <strong>Sexta-feira, 31 de janeiro de 2025<\/strong> para prorroga\u00e7\u00f5es de contratos de arrendamento de apartamentos.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A partir dessa mesma data, a medida ir\u00e1 tamb\u00e9m eliminar a possibilidade de os representantes pessoais notificarem em nome de um propriet\u00e1rio legal falecido.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Isto ter\u00e1 um impacto na forma como os profissionais lidam com as prorroga\u00e7\u00f5es de contrato de arrendamento, especialmente nos casos em que o apartamento est\u00e1 prestes a ser vendido.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Revis\u00e3o judicial da LFRA 2024<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ironicamente, na v\u00e9spera da entrada em vigor da primeira medida acima referida, em 30 de janeiro de 2025, uma audi\u00eancia no Tribunal Real de Justi\u00e7a concedeu a um grupo de seis senhorios autoriza\u00e7\u00e3o, em todos os fundamentos, para requerer a revis\u00e3o judicial da LFRA 2024, com base no facto de esta ser incompat\u00edvel com a Lei dos Direitos Humanos de 1998.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prev\u00ea-se que a audi\u00eancia completa tenha lugar por volta de julho de 2025. Isto suscita mais d\u00favidas significativas relativamente \u00e0s altera\u00e7\u00f5es propostas e \u00e0 possibilidade de estas virem a ser implementadas.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9 evidente que a aboli\u00e7\u00e3o do valor do casamento e a redu\u00e7\u00e3o significativa da avalia\u00e7\u00e3o do patrim\u00f3nio de um senhorio poderiam constituir uma viola\u00e7\u00e3o do direito \u00e0 propriedade; por isso, aguardaremos o desfecho com grande expectativa.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contactar-nos<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9 evidente que se trata de um panorama em constante evolu\u00e7\u00e3o.
