Sob <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2013\/26\/section\/3\">Sec\u00e7\u00e3o 3 do <em>Lei da Difama\u00e7\u00e3o de 2013<\/em><\/a>, O arguido deve demonstrar que:\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A) A declara\u00e7\u00e3o \u00e9 uma opini\u00e3o genu\u00edna.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">B) A opini\u00e3o baseia-se em factos que existiam quando a declara\u00e7\u00e3o foi feita.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">C) Uma pessoa honesta poderia ter tido essa opini\u00e3o, com base em:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Factos que existiam no momento da publica\u00e7\u00e3o, ou\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Factos afirmados numa declara\u00e7\u00e3o privilegiada publicada anteriormente.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Esta defesa n\u00e3o se aplica se o requerente puder provar que o requerido n\u00e3o tinha genuinamente a opini\u00e3o ou fez a declara\u00e7\u00e3o com mal\u00edcia.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Privil\u00e9gio<\/strong>\u00a0<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">O privil\u00e9gio \u00e9 uma defesa que protege determinadas declara\u00e7\u00f5es, independentemente da sua veracidade ou do preju\u00edzo que causam.
