O comunicado de imprensa centrou-se nas altera\u00e7\u00f5es que, segundo o Governo, tornariam o processo \u201cmais justo\u201d para o arrendat\u00e1rio.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>O panorama dos arrendamentos de longa dura\u00e7\u00e3o<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">H\u00e1 mais de tr\u00eas d\u00e9cadas que o&nbsp;<em>Lei de 1993 sobre a Reforma do Regime de Arrendamento, a Habita\u00e7\u00e3o e o Desenvolvimento Urbano<\/em>&nbsp;tem regulamentado a aquisi\u00e7\u00e3o da propriedade plena de arrendamentos. Esta legisla\u00e7\u00e3o, no entanto, tem sido motivo de controv\u00e9rsia. Os cr\u00edticos argumentam que o custo da prorroga\u00e7\u00e3o do contrato de arrendamento era demasiado elevado e que os compradores incautos do que pareciam ser arrendamentos de longa dura\u00e7\u00e3o, como por exemplo de 99 anos, teriam em breve de pagar montantes potencialmente significativos para prorrogar o seu contrato de arrendamento.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">De um modo geral, o processo tem sido considerado favor\u00e1vel ao senhorio, uma vez que:<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">(1) receberiam pr\u00e9mios potencialmente significativos, especialmente quando o prazo do contrato de arrendamento fosse inferior a 80 anos, uma vez que isso atrairia o \u2018valor de casamento\u2019;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">(2) o arrendat\u00e1rio era obrigado a pagar as despesas processuais razo\u00e1veis incorridas pelo senhorio.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>Medida do Governo: O projeto de lei sobre a reforma do regime de arrendamento e da propriedade plena<\/strong><\/h2>\n\n\n\n<p>No final de 2023, o governo revelou o&nbsp;<a href=\"https:\/\/bills.parliament.uk\/bills\/3523\">projeto de lei sobre a reforma do regime de arrendamento e da propriedade plena<\/a>, que se encontra atualmente em fase de aprecia\u00e7\u00e3o em comiss\u00e3o. O projeto de lei introduziria as seguintes altera\u00e7\u00f5es fundamentais ao atual sistema de aquisi\u00e7\u00e3o da propriedade plena em arrendamentos:<br><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">\u2013 Eliminar o requisito de que o arrendat\u00e1rio seja propriet\u00e1rio do im\u00f3vel h\u00e1 dois anos para dar in\u00edcio ao processo;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">\u2013 Aumentar o prazo de prorroga\u00e7\u00e3o obrigat\u00f3ria de 90 anos para uns impressionantes 990 anos;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">\u2013 Eliminar a obriga\u00e7\u00e3o de o arrendat\u00e1rio pagar o \u2018valor de casamento\u2019;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">\u2013 Eliminar a possibilidade de o senhorio recuperar os seus custos junto do arrendat\u00e1rio na maioria das situa\u00e7\u00f5es.<br><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-lg-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>Emancipa\u00e7\u00e3o coletiva<\/strong><\/h3>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">As altera\u00e7\u00f5es propostas v\u00e3o al\u00e9m dos arrendat\u00e1rios individuais. A aquisi\u00e7\u00e3o coletiva do direito de propriedade, nomeadamente em edif\u00edcios de uso misto, tamb\u00e9m ser\u00e1 alvo de reforma:<br><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">\u2013 O limite percentual das \u00e1reas n\u00e3o residenciais em edif\u00edcios de uso misto, que impediria os arrendat\u00e1rios residenciais de adquirirem a propriedade plena, aumenta de 25% para 50%;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">\u2013 O senhorio pode ser obrigado a assumir o arrendamento de volta de quaisquer apartamentos do edif\u00edcio que n\u00e3o participem no programa, o que reduziria o pr\u00e9mio total a pagar.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>O bra\u00e7o de ferro: senhorios vs. inquilinos<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Embora estas reformas representem uma lufada de ar fresco para os arrendat\u00e1rios, os senhorios podem n\u00e3o estar t\u00e3o entusiasmados. Prev\u00ea-se que os grupos de press\u00e3o dos senhorios venham a exercer press\u00e3o sobre o Governo para que este introduza altera\u00e7\u00f5es, especialmente no que diz respeito \u00e0 aboli\u00e7\u00e3o efetiva do \u00abvalor do casamento\u00bb. Alguns senhorios ter\u00e3o adquirido im\u00f3veis e pago montantes mais elevados com base nos pr\u00e9mios futuros que seriam recebidos pelos arrendat\u00e1rios. Agora, correm o risco de perder pr\u00e9mios consider\u00e1veis sem qualquer compensa\u00e7\u00e3o. Colocam-se quest\u00f5es sobre se isto iria contra os direitos do senhorio, o que poder\u00e1 potencialmente conduzir a lit\u00edgios nesta \u00e1rea.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>O dilema dos arrendat\u00e1rios<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Os arrendat\u00e1rios enfrentam agora um dilema. A perspetiva de esperar que estas reformas entrem em vigor, garantindo uma prorroga\u00e7\u00e3o mais longa e, potencialmente, poupando nos pr\u00e9mios, \u00e9 tentadora. No entanto, a incerteza quanto \u00e0 data em que estas altera\u00e7\u00f5es entrar\u00e3o em vigor e se a vers\u00e3o final estar\u00e1 em conformidade com o projeto atual suscita preocupa\u00e7\u00f5es.
