Geschillen inzake erfrecht<\/h2>\n\n\n\n

Helaas komt het vaak voor dat er na het overlijden van een dierbare geschillen ontstaan. Wat voor uitdagingen u of uw familie ook tegenkomen, ons team voor erfrechtelijke geschillen beschikt over de kennis en ervaring om u te helpen. Wij kunnen u adviseren over de beste aanpak van elk geschil, of het nu gaat om een rechtszaak of bemiddeling, om uw belangen te beschermen en omstreden erfrechtelijke geschillen soepel, tactvol en effectief op te lossen.<\/strong><\/h4>\n\n\n\n

Wij staan regelmatig bij in geschillen over de inhoud van een testament, de omvang of het ontbreken van een erfenis, of de wijze waarop een nalatenschap wordt beheerd.<\/p>\n\n\n\n

Als u van mening bent dat er in een testament of volgens de regels voor erfopvolging bij versterf onvoldoende in u is voorzien, kunnen wij u adviseren of u bij de rechtbank een verzoek kunt indienen om een redelijke toewijzing op grond van de Inheritance (Provision for Family and Dependants) Act 1975. Dit geldt zelfs als de overledene geen testament heeft opgesteld of als u niet tevreden bent met een testament, ook al bent u ervan overtuigd dat het geldig is.<\/p>\n\n\n\n

De rol van executeur (of beheerder) is een zware taak, en er zijn regels die moeten worden nageleefd. Als een executeur de nalatenschap niet correct beheert, kan hij of zij persoonlijk aansprakelijk worden gesteld voor eventuele verliezen van de nalatenschap. Het is mogelijk om de executeur uit zijn functie te ontheffen en door iemand anders te vervangen. Wij kunnen u bij deze zaken bijstaan, of u nu zelf de rol van executeur of beheerder vervult en ervoor moet zorgen dat u aan de relevante verantwoordelijkheden voldoet, of in het geval dat u ontevreden bent over het gedrag van de huidige executeur\/beheerder.<\/p>\n\n\n\n

Ons Private Client-team kan ook optreden als onafhankelijke beheerders en de afwikkeling van de nalatenschap op zich nemen wanneer de aangewezen executeurs geen overeenstemming kunnen bereiken en zijn ontslagen of ermee hebben ingestemd zich terug te trekken.<\/p>\n\n\n\n
