{"id":2075,"date":"2024-02-20T14:00:17","date_gmt":"2024-02-20T14:00:17","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?page_id=2075"},"modified":"2024-03-05T17:11:43","modified_gmt":"2024-03-05T17:11:43","slug":"recht-om-te-kopen","status":"publish","type":"page","link":"https:\/\/rfblegal.co.uk\/nl\/diensten\/persoonlijk-recht\/residentieel-vastgoed\/recht-om-te-kopen\/","title":{"rendered":"Recht om te kopen"},"content":{"rendered":"<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"font-style:normal;font-weight:600\">Recht van eerste weigering<\/h2>\n\n\n\n<h4 class=\"wp-block-heading has-lg-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);font-style:normal;font-weight:500\">We hebben een gespecialiseerd team dat zich bezighoudt met zaken die betrekking hebben op de Landlord and Tenant Act 1987, die bepaalde erfpachters een voorkeursrecht geeft om de freehold of superior leasehold van hun gebouw te kopen als de verhuurder besluit om het af te stoten.<\/h4>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">De Landlord and Tenant Act 1987 (\u2018de wet van 1987\u2019) geeft een voorkeursrecht aan \u201cin aanmerking komende huurders\u201d door bepaalde verhuurders te verbieden om bepaalde panden te verkopen zonder de verkoop eerst aan te bieden aan de \u201cin aanmerking komende huurders\u201d van het gebouw.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">De wet van 1987 is van toepassing op gebouwen die het geheel of een deel zijn van een gebouw dat twee of meer appartementen bevat die worden gehouden door in aanmerking komende huurders, en meer dan de helft van de appartementen in het gebouw wordt gehouden door in aanmerking komende huurders. De wet van 1987 is niet van toepassing op gebouwen waarin meer dan 50% van het interne vloeroppervlak wordt gebruikt voor niet-residenti\u00eble doeleinden.&nbsp;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">De definitie van \u201cin aanmerking komende huurder\u201d in de wet van 1987 omvat pachters en de meeste vaste of periodieke pachtovereenkomsten, maar sluit kortlopende of verzekerde pachtovereenkomsten, bedrijfs- en landbouwpachtovereenkomsten en pachtovereenkomsten die afhankelijk zijn van werk uit. Een huurder die eigenaar is van een huurcontract van drie of meer appartementen in het gebouw is ook uitgesloten als \u201cin aanmerking komende huurder\u201d.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">De wet van 1987 is veelomvattend, aangezien deze van toepassing is op \u201crelevante vervreemdingen\u201d, dat wil zeggen vervreemdingen door de verhuurder van enig landgoed of belang in het pand (met inbegrip van enig landgoed of belang in de gemeenschappelijke delen).<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Ervan uitgaande dat aan de kwalificatiecriteria is voldaan, is het essentieel dat de vereisten van de wet van 1987 strikt worden gevolgd.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Een verhuurder die niet voldoet aan de eisen van de wet van 1987 begaat een strafbaar feit en kan bij veroordeling een boete krijgen.
