As part of the legal team<\/a> for Oxford Bedrijf<\/a> College (OBC), I have witnessed firsthand a case that strikes at the heart of administrative justice and governmental overreach. The successful Judicial Review<\/a> of the Decision to de-designate OBC’s courses, culminating in a High Court victory on Friday, 22nd August 2025, is more than a win for one institution; it is a stark reminder of the necessity for fairness, transparency<\/a>, and the rule of law when the state apparatus engages with private<\/a> enterprise. <\/p>\n\n\n\n Oxford Business College, founded in 1985, has a commendable history of widening participation in higher education<\/a>, often tbv<\/a> as a vital steppingstone for students from disadvantaged backgrounds. It operates through franchise agreements<\/a> with five Lead Providers\u2014registered Higher Education institutions regulated by the Office for Students (OfS). This model is a well-established and successful component of the UK’s higher education landscape. The regelgeving<\/a> relationship is clear: the OfS oversees the Lead Providers, who in turn are contractually responsible for ensuring<\/a> the quality and compliance of their franchise partners<\/a> like OBC. <\/p>\n\n\n\n The peculiarity of this case began in mid-2024 when the Department for Education (DfE) bypassed this established regulatory structure. Citing an investigation by the Student Loans Company (SLC) into concerning patterns that might indicate the presence of non-genuine students, the DfE initiated direct contact<\/a> with OBC. <\/p>\n\n\n\n Despite the absence of any direct regulatory relationship, the college chose to cooperate in good faith, viewing the investigation as an opportunity to identify and rectify<\/a> any potential procedural weaknesses. This was in line with the findings of its own Lead Providers, whose prior investigations had found no wrongdoing and had merely recommended a scheme for continued monitoring and process improvement. <\/p>\n\n\n\n What ensued was a Kafkaesque ordeal. The college’s reasonable requests for the very information needed to meaningfully engage<\/a> with the investigation were consistently met with refusal<\/a> and obfuscation. Promises of “emerging findings” from the government’s investigators, the Government<\/a> Internal Audit Agency (GIAA), never materialised, leaving OBC to grapple with a formless and ever-shifting set of undisclosed standards. <\/p>\n\n\n\n The process was not just opaque; it was fundamentally flawed. It later came to light during legal proceedings that the GIAA’s investigation was based on a sample of 200 students that was not selected at random. Instead, the GIAA had deliberately selected 200 specific students of potential concern. This crucial fact, which fundamentally skewed the investigation’s findings from the outset, was hidden from OBC. Drawing conclusions about<\/a> a student body of 5,400 from such a sample is a deeply flawed methodology, yet it formed the basis of the DfE’s entire case. <\/p>\n\n\n\n Furthermore, the DfE’s handling<\/a> of the GIAA’s reports demonstrated a shocking lack of transparency. The full, unredacted reports, which were finally disclosed to OBC just one working day before the substantive hearing, revealed a narrative starkly different from the one presented by the DfE. The DfE had stated in a witness statement that \u201cA small number<\/a> of further redactions were made to information that was not relevant to or outside the scope of the investigation\u201d. This echoed the sentiment in OBC refusal letter which state that \u201cthese<\/em> <\/em>documents<\/a> were subject to only minimal redaction to remove details<\/a> that might reveal the identities of individuals or material connected to other investigations\u201d<\/em>. <\/p>\n\n\n\n The complete reports did not support<\/a> the draconian measure of de-designation. Instead, they recommended \u201cstrikte documentatieprotocollen, consistente verificatieprocedures en versterking van de toelatingsprocedure...\u201d. \u201cgestandaardiseerde procedures\u201d \u201cregelmatige audits van de naleving van documentatie\u201d,<\/em> a far cry from the wholesale shutdown which the Secretary of State ultimately pursued. The standard<\/a> approach of identifying where redactions were made was not followed. The DfE had systematically excised all factual underpinnings and recommendations from the summary<\/a> reports provided to the college, going so far as to re-number paragraphs to conceal the existence of redactions or appendices. This calculated act of concealment made it impossible for OBC to comment on the factual accuracy of the findings against it. <\/p>\n\n\n\n De situatie escaleerde dramatisch met de \u201cminded to\u201d-beslissing, die aan OBC werd overhandigd met een onredelijk korte antwoordtermijn. In een beweging waarvan werd toegegeven dat het \u201cpolitiek\u201d was - een term die in de rechtszaal werd gebruikt door de eigen raadsman van het DfE.De Sunday Times<\/em> bleek te zijn ingelicht over de beslissing en publiceerde een schadelijk en ongefundeerd artikel naast een opiniestuk van de minister van Buitenlandse Zaken, Bridget Phillipson, die verklaarde dat ze van plan was \u201c...\u201cde meest vastberaden actie<\/em>\u201dslechts enkele dagen voordat de beslissing werd genomen. <\/p>\n\n\n\n OBC’s pleas for the underlying evidence<\/a> needed to formulate a proper response were denied. Its comprehensive 68-page representation was summarily dismissed as a mere “onenigheid over interpretatie.<\/em>\u201d Ondertussen werden ondersteunende opmerkingen van haar universitaire partners, waaronder voorstellen voor een \u201cteach out\u201d-optie en uitdagingen tegen de verwijzing van het DfE naar onjuist beleid, schijnbaar genegeerd. <\/p>\n\n\n\n The lack of candour continued into the judicial review proceedings. A senior<\/a> civil<\/a> servant provided a statement that was \u201cwezenlijk misleidend\u201d<\/em>, en bagatelliseerde de substanti\u00eble verschillen tussen de samenvatting en de volledige GIAA rapporten. Alleen door aanhoudende juridische druk werden de ongecensureerde rapporten uiteindelijk te elfder ure openbaar gemaakt, waardoor de ware aard van de bevindingen van de GIAA en de omvang van de onjuiste voorstelling van zaken door het DfE aan het licht kwamen. <\/p>\n\n\n\n De uitspraak van het Hooggerechtshof was een eclatante rechtvaardiging voor OBC. De geachte rechter Naomi Ellenbogen vond dat het college tijdens het proces niet had voldaan aan de basisprincipes van natuurlijke gerechtigheid. Ze verklaarde <\/p>\n\n\n\n “In all the circumstances…I am satisfied on the facts of this case that absent counter prevailing public policy reason procedural fairness dictated that OBC was entitled to full disclosure<\/a> of the evidence and findings against it… Only on that basis could OBC have a fair crack of the whip.” <\/p>\n\n\n\n De rechtbank erkende ook dat de contracten van OBC met haar partners een \u201cbezit\u201d<\/em> under Article 1 of Protocol 1 of the European Convention<\/a> on Human Rights, opening the door for a future claim for damages. <\/p>\n\n\n\n Cruciaal is dat de staatssecretaris op de eerste dag van de rechtszaak toegaf dat er “nothing stopping from OBC setting up a new franchise agreement<\/a>,”<\/em> en dat alle nieuwe opleidingen automatisch zouden worden aangewezen. Dit is een belangrijke stap terug ten opzichte van de oorspronkelijke beslissing, die tot doel had OBC uit de sector te weren. <\/p>\n\n\n\n This case serves as a cautionary tale of governmental overreach. It underscores the principle that citizens and their businesses must be treated with procedural fairness and objectivity, free<\/a> from political pressures.
