{"id":5696,"date":"2025-01-31T10:56:58","date_gmt":"2025-01-31T10:56:58","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=5696"},"modified":"2025-04-29T13:29:18","modified_gmt":"2025-04-29T13:29:18","slug":"updates-en-uitdagingen-voor-de-hervorming-van-de-collectieve-enfranchising-van-huurverlengingen","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/nl\/inzichten\/updates-en-uitdagingen-voor-de-hervorming-van-de-collectieve-enfranchising-van-huurverlengingen\/","title":{"rendered":"Updates en uitdagingen voor de hervorming van huurverlenging en collectieve bevrijdingsrechten"},"content":{"rendered":"<h2 class=\"wp-block-heading\"><strong>De 2-jarenregel afschaffen<\/strong>\u00a0<\/h2>\n\n\n\n<p>Het passeren van de <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2024\/22#:~:text=An%20Act%20to%20prohibit%20the,manage%20the%20buildings%20containing%20their\">Leasehold and Freehold Reform Act 2024 (LFRA 2024)<\/a> werd gezien als een startpunt voor de langverwachte hervormingen op het gebied van verlenging van huurovereenkomsten, collectief vruchtgebruik en het recht op beheer. De voorgestelde hervormingen waren, eerlijk is eerlijk, overwegend huurdersvriendelijk met enkele van de belangrijkste punten:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De eis van 2 jaar eigendom schrappen voor de erfpachter om het proces te starten;\u00a0<\/li>\n\n\n\n<li>Verhoog de verplichte verlenging van 90 jaar naar maar liefst 990 jaar;\u00a0<\/li>\n\n\n\n<li>De eis schrappen dat de erfpachter \u2018huwelijkswaarde\u2019 moet betalen;\u00a0<\/li>\n\n\n\n<li>De mogelijkheid van de verhuurder om zijn kosten te verhalen op de erfpachter in de meeste situaties wegnemen.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>De LFRA 2024 bevatte echter geen ingangsdatum of berekeningen over hoe een nieuw regime zou werken, waardoor secundaire wetgeving nodig zou zijn om de voorgestelde wijzigingen door te voeren.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Er werd echter gefluisterd dat dergelijke huurdersvriendelijke hervormingen zouden worden aangevochten door grote groepen verhuurders als mogelijk in strijd met hun mensenrechten, aangezien het afschaffen van de huwelijkswaardebetalingen mogelijk miljoenen ponden van de vastgoedmarkt zou vegen zonder enige compensatie.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In de toespraak van de koning bevestigde Labour dat sommige van de voorgestelde wijzigingen meer tijd zouden vergen om te overwegen, maar dat sommige van de laaghangende vruchten op kortere termijn zouden kunnen worden aangepakt.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Daartoe is nu de eerste inwerkingtredingsverordening aangenomen die de eis van 2 jaar eigendom actief afschaft vanaf <strong>Vrijdag 31 januari 2025<\/strong> voor huurverlengingen van flats.&nbsp;<\/p>\n\n\n\n<p>Vanaf dezelfde datum kunnen persoonlijke vertegenwoordigers ook geen aankondigingen meer doen namens een overleden wettige eigenaar.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Dit zal invloed hebben op de manier waarop praktijkmensen omgaan met huurverlengingen, vooral wanneer de flat het onderwerp is van een op handen zijnde verkoop.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Rechterlijke toetsing van LFRA 2024<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Ironisch genoeg werd daags voor de implementatie van de eerste implementatie hierboven, op 30 januari 2025 tijdens een hoorzitting bij de Royal Courts of Justice toestemming verleend aan een groep van zes verhuurders om op alle gronden een aanvraag in te dienen voor een Judicial Review van de LFRA 2024 op grond van het feit dat deze onverenigbaar is met de Human Rights Act 1998.&nbsp;<\/p>\n\n\n\n<p>Naar verwachting zal de volledige hoorzitting rond juli 2025 plaatsvinden. Dit zaait nog meer grote twijfel over de voorgestelde wijzigingen en de vraag of ze ooit zullen worden doorgevoerd.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Het is zeker te zien hoe het effectief afschaffen van de huwelijkswaarde en het aanzienlijk wegvagen van de portefeuillewaardering van een verhuurder het recht op eigendom zou kunnen schenden en we zullen daarom met ingehouden adem een resultaat afwachten.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Neem contact met ons op<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Het is duidelijk dat dit een voortdurend veranderend landschap is.
