Defamation occurs when false statements cause serious harm to a person&#8217;s reputation. The UK&#8217;s <em><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2013\/26\/contents\">Wet op smaad van 2013<\/a><\/em> allows individuals to bring a claim against someone who has made a <a href=\"https:\/\/rfblegal.co.uk\/nl\/inzichten\/hoe-om-te-gaan-met-lasterlijke-inhoud-op-internet-of-sociale-media\/\">defamatory<\/a> statement. If the defendant can prove that the defamatory statement is substantially true, they <a href=\"https:\/\/rfblegal.co.uk\/nl\/inzichten\/kan-een-testament-mijn-eerdere-overeenkomsten-annuleren\/\">zal<\/a> not be liable, regardless of any damage to the claimant\u2019s reputation. The defendant bears the burden of proving the truth of the statement on the balance of probabilities. Crucially, not <a href=\"https:\/\/rfblegal.co.uk\/nl\/inzichten\/the-renters-rights-act-2025-what-every-landlord-needs-to-know\/\">every<\/a> detail of the statement needs to be true, as long as the essential substance, or the &#8220;sting&#8221; of the statement, is accurate.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Eerlijke mening<\/strong>\u00a0<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">De verdediging van de oprechte mening, voorheen bekend als <em>\u201cterugwending,\u201d<\/em> beschermt meningsuitingen in plaats van feitelijke beweringen. Krachtens <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2013\/26\/section\/3\">Artikel 3 van de <em>Wet op smaad van 2013<\/em><\/a>, moet de verweerder aantonen dat:\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A) De uitspraak was een oprecht gekoesterde mening.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">B) Het oordeel was gebaseerd op feiten die op het moment dat de uitspraak werd gedaan, bestonden.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">C) Een eerlijk persoon zou de mening kunnen hebben gehad, op basis van:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Feiten die ten tijde van de publicatie bekend waren, of\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Feiten die zijn vermeld in een eerder gepubliceerde vertrouwelijke verklaring.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Dit verweer is niet van toepassing indien de eiser kan aantonen dat de verweerder die mening niet oprecht koesterde of de uitspraak met kwade opzet heeft gedaan.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Voorrecht<\/strong>\u00a0<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Voorrecht is een verweer dat bepaalde uitspraken beschermt, ongeacht of ze waar zijn of welke schade ze veroorzaken. Er zijn twee soorten voorrecht:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Absoluut voorrecht<\/strong>: Dit biedt volledige bescherming voor uitspraken die in bepaalde situaties worden gedaan, zoals tijdens parlementaire debatten of voor de rechter. Zelfs als de uitspraak lasterlijk is, kan er geen rechtszaak worden aangespannen.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Gekwalificeerd voorrecht<\/strong>: Dit geldt wanneer de verweerder een plicht of een belang had bij het doen van de uitspraak, en de ontvanger een overeenkomstig belang had bij het ontvangen ervan. This defence aims to safeguard responsible journalism and other communications on issues of public <a href=\"https:\/\/rfblegal.co.uk\/nl\/inzichten\/het-belang-van-aandeelhoudersovereenkomsten\/\">importance<\/a>. The court will consider the overall <a href=\"https:\/\/rfblegal.co.uk\/nl\/inzichten\/qa-arbeidsrecht-in-een-bedrijfscontext\/\">context<\/a>, including the seriousness of the allegation, the source of the information, and the steps taken to verify the facts.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Onschuldige verspreiding<\/strong>\u00a0<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">De verdedigingsgrond van onschuldige verspreiding biedt bescherming aan degenen die niet de auteur, redacteur of primaire uitgever van lasterlijke inhoud zijn, maar wel betrokken waren bij de verspreiding ervan, zoals internetproviders of bibliotheken. Om in het gelijk te worden gesteld, moet de verweerder aantonen dat hij redelijke zorgvuldigheid in acht heeft genomen bij de publicatie en geen reden had om aan te nemen dat de inhoud lasterlijk was.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Aanbod tot verzoening<\/strong>\u00a0<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An offer of amends, a <a href=\"https:\/\/rfblegal.co.uk\/nl\/inzichten\/wettelijk-overlastadvies-voor-verhuurders-en-beheerders\/\">statutory<\/a> defence under the <em><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1996\/31\/contents\">Wet op smaad van 1996<\/a><\/em>, biedt de gedaagde de mogelijkheid om zijn excuses aan te bieden, de lasterlijke uitspraak te corrigeren en schadevergoeding te betalen.
