Wanneer een partij een vonnis verkrijgt in een buitenlandse rechtbank, kan het afdwingen van dat vonnis in Engeland en Wales cruciaal zijn voor het verkrijgen van de gewenste genoegdoening. Dit artikel bespreekt de juridische mechanismen en procedurele stappen voor het afdwingen van buitenlandse vonnissen in Engeland en Wales, met de nadruk op het Common Law Regime.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Wettelijk kader voor handhaving<\/strong>&nbsp;<\/h2>\n\n\n\n<p>De tenuitvoerlegging van een buitenlands vonnis in Engeland en Wales wordt grotendeels geregeld door een combinatie van wettelijke bepalingen, internationale verdragen en gewoonterechtbeginselen.&nbsp;<\/p>\n\n\n\n<p>Afhankelijk van waar de beslissing vandaan komt en de datum waarop de procedure werd gestart, moet worden bepaald welk kader de tenuitvoerlegging van de buitenlandse beslissing beheerst. Specifiek zijn er vijf algemene stelsels die de tenuitvoerlegging van de buitenlandse beslissing regelen&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Het Britse regime\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Het Europese regime\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De wettelijke regeling\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Het gewoonterechtstelsel\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Haags Verdrag inzake bedingen van forumkeuze\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Gewoonterechtstelsel<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Bij gebrek aan toepasselijke wettelijke regelingen of verdragen is het gewoonterecht de standaard voor vonnissen die worden verkregen in landen zoals de VS, Rusland of Hongkong (SAR).&nbsp;<\/p>\n\n\n\n<p>In tegenstelling tot andere stelsels, die voorzien in de erkenning en tenuitvoerlegging van een buitenlands vonnis, vereist het common law-stelsel dat een nieuwe vordering wordt ingesteld in Engeland en Wales. Zolang aan bepaalde voorwaarden wordt voldaan, wordt een buitenlands vonnis behandeld als een schuld van de executieschuldenaar aan de executieschuldeiser, waarbij de Engelse rechtbank een Engels vonnis over die schuld velt.&nbsp;<\/p>\n\n\n\n<p>Om afdwingbaar te zijn onder het gewoonterechtstelsel, moet aan de volgende voorwaarden worden voldaan:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De buitenlandse rechtbank moet bevoegd zijn geweest om de beslissing te geven.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De uitspraak moet onherroepelijk zijn.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De uitspraak moet een bepaald geldbedrag betreffen.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Het vonnis moet ten gronde zijn gewezen.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>De tenuitvoerlegging van een buitenlands vonnis in Engeland en Wales is vaak de laatste stap in het veiligstellen van de genoegdoening die door de buitenlandse rechtbank is toegekend.
