A final award is typically enforceable in most domestic courts around the world and, subject to the arbitration rules which apply, there is generally no right<\/a> to appeal<\/a> the award and very limited grounds on which any award can be set aside. <\/p>\n\n\n\n

Yes, you can. As the parties will need to agree to submit their dispute to arbitration, the most common way for the parties to do so is to incorporate an arbitration clause into the underlying agreements\/contracts. However, parties can still refer their dispute to arbitration through a submission agreement<\/a> if no pre-existing arbitration clause exists.<\/p>\n\n\n\n

Uitvoerbaarheid van Awards:<\/strong> One of the most significant advantages<\/a> of international arbitration is the enforceability of arbitral awards across different jurisdictions. Het Verdrag over de erkenning en tenuitvoerlegging van buitenlandse scheidsrechterlijke uitspraken van 1958<\/a><\/em>, widely known as \u2018The New York Convention<\/a>,\u2019 has been ratified by over 170 countries, making it often easier to enforce a non-domestic arbitral award than a foreign court judgment.<\/p>\n\n\n\n

Neutraliteit en onpartijdigheid:<\/strong> Arbitrators are typically chosen by the parties or a designated institution, ensuring<\/a> a neutral and impartial decision-making process. This neutrality is crucial for cross-border disputes, as it minimises the risk of home-country bias or concerns about<\/a> unfamiliar domestic judicial systems.<\/p>\n\n\n\n

Flexibiliteit en autonomie:<\/strong> Parties have the freedom to tailor the arbitration process to their specific needs, including selecting specialist arbitrators, specific procedural<\/a> rules (e.g., ICC 2021 Rules, LCIA 2020 Rules, etc.), the \u2018seat\u2019 of arbitration, and the language of proceedings. This flexibility allows for a more efficient and customised resolution process.<\/p>\n\n\n\n

Terwijl een traditionele procedure bij een binnenlandse rechtbank vaak jaren kan duren, bepalen veel van de regels die gelden voor internationale arbitrage dat de partijen, afhankelijk van de geschiktheid, kunnen kiezen voor een versnelde procedure waarbij binnen 3 tot 6 maanden na het begin van de procedure een definitieve uitspraak wordt gedaan.  <\/p>\n\n\n\n

Vertrouwelijkheid:<\/strong> In tegenstelling tot procedures voor nationale rechtbanken, die vaak openbaar zijn, wordt internationale arbitrage meestal priv\u00e9 gevoerd, waarbij partijen kunnen overeenkomen om het bestaan en de inhoud van de arbitrage vertrouwelijk te houden.<\/p>\n\n\n\n
