{"id":3206,"date":"2023-12-19T13:31:40","date_gmt":"2023-12-19T13:31:40","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=3206"},"modified":"2025-11-14T14:33:58","modified_gmt":"2025-11-14T14:33:58","slug":"sectie-21-van-de-huisvestingswet-1988-te-handhaven-totdat-de-rechtbanken-zijn-verbeterd","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/nl\/inzichten\/sectie-21-van-de-huisvestingswet-1988-te-handhaven-totdat-de-rechtbanken-zijn-verbeterd\/","title":{"rendered":"Sectie 21 van de Huisvestingswet 1988 blijft van kracht totdat er verbeteringen zijn aangebracht in de rechtbanken"},"content":{"rendered":"<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Na campagnes van de&nbsp;<a href=\"https:\/\/www.nrla.org.uk\/\"><strong><em>Landelijke vereniging van huiseigenaren<\/em><\/strong><\/a>&nbsp;en anderen heeft de regering geaccepteerd dat de rechtbanken hervormd moeten worden voordat section 21 \u2018no fault evictions\u2019 wordt afgeschaft.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Er was ook positief nieuws voor verhuurders van studentenwoningen: de regering kondigde aan dat er nu een nieuwe bezitsgrond komt voor verhuurders van studentenwoningen, zodat ze hun eigendommen aan het einde van het academische jaar kunnen terugnemen.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">De wijzigingen werden aangekondigd enkele dagen voor de lezing van het tweede wetsvoorstel in oktober 2023, na een verslag van de&nbsp;<a href=\"https:\/\/committees.parliament.uk\/committee\/17\/levelling-up-housing-and-communities-committee\"><strong><em>Nivellering, Bijzondere Commissie voor huisvesting en gemeenschappen<\/em><\/strong><\/a>&nbsp;eerder dit jaar, die het merendeel van de voorstellen van de NRLA steunde. De Transparty Housing Select Committee waarschuwde dat&nbsp;<em>\u201c<a href=\"https:\/\/committees.parliament.uk\/publications\/33924\/documents\/185831\/default\/\"><strong>het is niet duidelijk of de regering zich ten volle realiseert in welke mate een niet-hervormd rechtssysteem haar huurhervormingen zou kunnen ondermijnen<\/strong><\/a>\u201d.<\/em><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">In reactie hierop kondigde de regering aan dat een nieuw systeem voor het opnieuw in bezit nemen van eigendommen \u201cniet zal plaatsvinden totdat we oordelen dat er voldoende vooruitgang is geboekt om de rechtbanken te verbeteren\u201d en&nbsp;<em>\u201cDat betekent dat we niet verder gaan met het afschaffen van Sectie 21 totdat er hervormingen in het rechtssysteem zijn doorgevoerd\u201d.<\/em><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Momenteel duurt het gemiddeld meer dan een half jaar voordat de rechtbank een vordering tot inbezitneming behandelt als daar een goede reden voor is, zoals huurachterstand, antisociaal gedrag of wanneer de huisbaas weer een woning wil betrekken.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Het engagement om het systeem te hervormen is positief, maar er moet voor gezorgd worden dat elke hervorming van de rechtbank een systeem oplevert dat geschikt is voor het beoogde doel.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">In oktober 2023 werd ook aangekondigd dat de voorstellen om minimale energieprestatiecertificaten van C in te voeren in huurwoningen zijn geschrapt.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><em>Geschreven door Senior Litigation Partner\u00a0<a href=\"\/nl\/person\/david-burns\/\"><strong>David Burns<\/strong><\/a>\u00a0en advocaat-medewerker<strong>\u00a0<a href=\"\/nl\/person\/marissa-lawrence\/\">Marissa Lawrence<\/a><\/strong>.
