Tuttavia, poich\u00e9 i prestiti ponte sono caratterizzati da scadenze brevi e tassi di interesse elevati, presentano anche un alto tasso di insolvenza. Quando un mutuatario non riesce a estinguere il prestito nei tempi previsti, i finanziatori di prestiti ponte in genere aggirano i lunghi iter giudiziari e nominano immediatamente curatori fallimentari con diritto di pegno fisso o ai sensi del Law of Property Act (LPA) per sequestrare e vendere l\u2019immobile dato in garanzia.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Storicamente, un paradosso operativo ha rallentato questa procedura esecutiva nel caso degli immobili ad uso proprio. In base alle condizioni standard dei mutui ipotecari, i curatori fallimentari sono designati per legge come rappresentanti del mutuatario al fine di tutelare il creditore da eventuali responsabilit\u00e0. La vendita di un immobile con inquilini o con il proprietario ancora residente al suo interno ne riduce il valore di mercato e ritarda la transazione.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gli istituti di credito si affidano al <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/Geo5\/15-16\/20\/contents\">Legge sulla propriet\u00e0 del 1925<\/a> e prevedere clausole ipotecarie che consentano la nomina di curatori fallimentari. Quando il prestito \u00e8 andato in default, il creditore ha nominato dei curatori congiunti incaricati di assumere il controllo del bene.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Poich\u00e9 i Menon continuavano a risiedere nell\u2019abitazione, i curatori fallimentari hanno avviato un procedimento di presa di possesso presso il Tribunale della contea. Il giudice Mann ha spiegato che il diritto di un curatore fallimentare di prendere possesso deriva dal fatto che:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L'ipoteca conferisce esplicitamente al beneficiario il potere di gestire, coltivare e vendere l'immobile.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Un immobile non pu\u00f2 essere gestito in modo efficace n\u00e9 venduto al suo pieno valore a meno che il curatore fallimentare non riesca a ottenere il possesso libero da occupanti.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Negare al creditore il diritto di sfrattare un mutuatario che occupa l'immobile renderebbe inattuabile il contratto di garanzia, contraddicendo i principi fondamentali dell'efficienza commerciale.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La sentenza ha confermato che un curatore fallimentare non ha bisogno di un patrimonio formale per rivendicare il possesso. \u00c8 sufficiente che disponga di un diritto di possesso superiore a quello del mutuatario, sancito dal contratto, che entra in vigore nel momento in cui la garanzia sottostante diventa esecutiva.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Il lato positivo per i mutuatari: la discrezionalit\u00e0 prevista dalla Sezione 36&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Mentre&nbsp;<em>Menon contro Pask<\/em>&nbsp;Oltre a rafforzare le opzioni a disposizione dei finanziatori, ha anche introdotto una tutela fondamentale per i mutuatari privati di immobili residenziali.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il tribunale ha valutato se un mutuatario potesse fare affidamento su <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1970\/31\/section\/36\">Articolo 36 della legge sull'amministrazione della giustizia del 1970<\/a> per ritardare o sospendere i procedimenti di espropriazione avviati da un curatore fallimentare. Il tribunale ha deciso che il curatore fallimentare agisce come strumento per far valere i diritti di propriet\u00e0 del creditore.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Di conseguenza, un mutuatario privato pu\u00f2 chiedere al tribunale di rinviare, sospendere o rinviare l'esecuzione di un'ordinanza di sfratto, purch\u00e9 sia in grado di dimostrare di disporre di un piano realistico per estinguere il mutuo o saldare gli arretrati entro un termine ragionevole.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Strategie pratiche per risolvere le controversie relative ai prestiti ponte&nbsp;<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Strategie per creditori e debitori<\/strong>&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bozza delle clausole relative al possesso esplicito:<\/strong>&nbsp;Assicurarsi che i contratti di prestito e i documenti relativi alle ipoteche indichino esplicitamente che il creditore ipotecario ha il diritto diretto di ottenere il possesso libero dell'immobile dal debitore ipotecario.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Presentare correttamente le richieste di risarcimento:<\/strong>&nbsp;Evitate l\u2019errore di indicare il mutuatario come attore \u201cagente per conto\u201d del curatore fallimentare. Assicuratevi che siano i curatori fallimentari ad avviare il contenzioso utilizzando i propri nomi personali.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Prepararsi alle discussioni relative alla Sezione 36:<\/strong>&nbsp;Quando si ha a che fare con immobili residenziali o singoli mutuatari, preparatevi a contestare i piani di rimborso irrealistici o le tempistiche di rifinanziamento non sostenibili avanzati dalla difesa.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Strategie per mutuatari e garanti<\/strong>&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Individuare le esenzioni aziendali:<\/strong>&nbsp;Se il mutuatario \u00e8 una persona giuridica o una societ\u00e0 a responsabilit\u00e0 limitata, la tutela prevista dall\u2019articolo 36 non \u00e8 applicabile. L\u2019attenzione deve quindi concentrarsi sulla contestazione della validit\u00e0 della nomina del curatore fallimentare o dell\u2019esattezza della comunicazione di inadempimento.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Presentare prove concrete relative all'uscita dall'investimento e al rimborso:<\/strong>&nbsp;Per ottenere con successo una proroga ai sensi dell\u2019articolo 36, i mutuatari devono presentare prove concrete, quali un\u2019offerta formale di riscatto da parte di un fornitore alternativo o un contratto di vendita in corso e verificato.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Verifica delle commissioni relative ai prestiti:<\/strong>&nbsp;Verificare se i tassi di interesse di mora e le spese amministrative applicati dall\u2019istituto di credito ponte costituiscano una penale illegale o creino un rapporto iniquo ai sensi della legge sul credito al consumo del 1974.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Sintesi&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La decisione in&nbsp;<em>Menon contro Pask<\/em>&nbsp;concilia l'utilit\u00e0 commerciale con la tutela dei consumatori nel settore dei finanziamenti ponte.
