{"id":3206,"date":"2023-12-19T13:31:40","date_gmt":"2023-12-19T13:31:40","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=3206"},"modified":"2025-11-14T14:33:58","modified_gmt":"2025-11-14T14:33:58","slug":"la-sezione-21-dellhousing-act-1988-deve-rimanere-in-vigore-fino-a-quando-non-saranno-apportati-miglioramenti-ai-tribunali","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/it\/approfondimenti\/la-sezione-21-dellhousing-act-1988-deve-rimanere-in-vigore-fino-a-quando-non-saranno-apportati-miglioramenti-ai-tribunali\/","title":{"rendered":"La sezione 21 dell'Housing Act 1988 deve rimanere in vigore fino a quando non saranno apportati miglioramenti ai tribunali"},"content":{"rendered":"<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">A seguito delle campagne promosse dal&nbsp;<a href=\"https:\/\/www.nrla.org.uk\/\"><strong><em>Associazione Nazionale dei Proprietari di Immobili Residenziali<\/em><\/strong><\/a>&nbsp;e altri, il Governo ha riconosciuto che \u00e8 necessario riformare i tribunali prima di poter abolire gli \u2018sfratti senza colpa\u2019 previsti dall\u2019articolo 21.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Ci sono state notizie positive anche per i proprietari di alloggi per studenti: il Governo ha infatti annunciato che introdurr\u00e0 un nuovo motivo di sfratto a favore dei proprietari di alloggi per studenti, per consentire loro di riprendere possesso dei propri immobili al termine dell\u2019anno accademico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le modifiche sono state annunciate pochi giorni prima della seconda lettura del disegno di legge, nell'ottobre 2023, a seguito di una relazione del&nbsp;<a href=\"https:\/\/committees.parliament.uk\/committee\/17\/levelling-up-housing-and-communities-committee\"><strong><em>Commissione speciale per lo sviluppo, l\u2019edilizia abitativa e le comunit\u00e0<\/em><\/strong><\/a>&nbsp;all\u2019inizio di quest\u2019anno, che ha appoggiato la maggior parte delle proposte della NRLA. La Commissione speciale interpartitica per l\u2019edilizia abitativa ha avvertito che&nbsp;<em>\u201c<a href=\"https:\/\/committees.parliament.uk\/publications\/33924\/documents\/185831\/default\/\"><strong>Non \u00e8 chiaro se il Governo sia pienamente consapevole di quanto un sistema giudiziario non riformato possa compromettere le sue riforme in materia di locazioni<\/strong><\/a>\u201d.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">In risposta, il Governo ha annunciato che qualsiasi nuovo sistema di pignoramento degli immobili \u201cnon entrer\u00e0 in vigore finch\u00e9 non riterremo che siano stati compiuti progressi sufficienti per migliorare il funzionamento dei tribunali\u201d e&nbsp;<em>\u201cCi\u00f2 significa che non procederemo all\u2019abolizione della Sezione 21 finch\u00e9 non saranno state attuate le riforme del sistema giudiziario\u201d.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Attualmente, i tribunali impiegano in media pi\u00f9 di sei mesi per esaminare le richieste di sfratto nei casi in cui sussistano validi motivi, quali morosit\u00e0 nell\u2019affitto, comportamenti antisociali o il desiderio del proprietario di rientrare nell\u2019immobile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">L'impegno a riformare il sistema \u00e8 positivo, ma \u00e8 necessario garantire che qualsiasi riforma giudiziaria porti alla creazione di un sistema adeguato alle finalit\u00e0 previste.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Nell'ottobre 2023 \u00e8 stato inoltre annunciato che le proposte volte a introdurre una classe energetica minima di C per gli immobili in affitto sono state accantonate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><em>Scritto da un socio senior dello studio legale specializzato in contenzioso\u00a0<a href=\"\/it\/person\/david-burns\/\"><strong>David Burns<\/strong><\/a>\u00a0e avvocato associato<strong>\u00a0<a href=\"\/it\/person\/marissa-lawrence\/\">Marissa Lawrence<\/a><\/strong>.
