  2. Testimonials
  • Jack was instructed in relation to a highly complex claim brought by two shareholders and former directors of a company, which had gone into administration, following breaches of director’s duties and the misfeasance of another director. The claim was complicated by the principle of reflective loss, although Jack argued that the claimants were entitled to bring a petition for unfair prejudice under section 994 of the Companies Act 2006

  • Jack was instructed in relation to a claim for breach of contract, misrepresentation and breach of director’s duties arising out of a director’s loan agreement. Jack was able to negotiate a settlement shortly after issuing proceedings, for the full value of the claim, in excess of £250,000, having pleaded there was an oral variation of the agreement and misrepresentations by the defendant.

  • Jack acted for a commercial landlord in relation to repossession of a premises and forfeiture of a lease for commercial rent arrears. This included advice in relation to waiver of forfeiture and relief from forfeiture, in the context of the Commercial Rent (Coronavirus) Act 2022.

  • Jack acted for a residential landlord in relation to accelerated possession proceedings following service of a section 21 notice. Subsequently the defendant sought to establish a 100% beneficial interest in the property arising from a constructive trust and sought a declaration pursuant to the Trusts of Land and Appointment of Trustees Act 1996.

  • Jack was instructed in relation to a claim against a well-known national homebuilder, arising from significant defects in the construction and design of the client’s property. Jack assisted in securing significant damages plus costs, including damages for blight and for loss of amenity.
