{"id":2075,"date":"2024-02-20T14:00:17","date_gmt":"2024-02-20T14:00:17","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?page_id=2075"},"modified":"2024-03-05T17:11:43","modified_gmt":"2024-03-05T17:11:43","slug":"droit-dachat","status":"publish","type":"page","link":"https:\/\/rfblegal.co.uk\/fr\/services\/droit-des-personnes\/propriete-residentielle\/droit-dachat\/","title":{"rendered":"Droit d'achat"},"content":{"rendered":"<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"font-style:normal;font-weight:600\">Droit de premier refus<\/h2>\n\n\n\n<h4 class=\"wp-block-heading has-lg-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);font-style:normal;font-weight:500\">Nous disposons d'une \u00e9quipe sp\u00e9cialis\u00e9e dans les questions relatives \u00e0 la loi de 1987 sur les propri\u00e9taires et les locataires (Landlord and Tenant Act 1987), qui conf\u00e8re \u00e0 certains titulaires de baux un droit de pr\u00e9emption pour l'achat du droit de propri\u00e9t\u00e9 ou du droit de bail sup\u00e9rieur de leur immeuble dans le cas o\u00f9 le propri\u00e9taire d\u00e9cide de s'en d\u00e9faire.<\/h4>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le Landlord and Tenant Act 1987 (loi de 1987) accorde un droit de pr\u00e9emption aux \u2018locataires qualifi\u00e9s\u2019 en interdisant \u00e0 certains propri\u00e9taires de proc\u00e9der \u00e0 certaines cessions de certains locaux sans proposer au pr\u00e9alable la cession aux \u201clocataires qualifi\u00e9s\u201d de l'immeuble.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">La loi de 1987 s'applique aux locaux qui constituent la totalit\u00e9 ou une partie d'un b\u00e2timent contenant au moins deux appartements occup\u00e9s par des locataires qualifi\u00e9s, et dont plus de la moiti\u00e9 des appartements sont occup\u00e9s par des locataires qualifi\u00e9s. La loi de 1987 ne s'applique pas aux b\u00e2timents dont plus de 50% de la surface int\u00e9rieure est occup\u00e9e \u00e0 des fins non r\u00e9sidentielles.&nbsp;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">La d\u00e9finition de \u201clocataire admissible\u201d dans la loi de 1987 inclut les titulaires de baux et la plupart des locations fixes ou p\u00e9riodiques, mais exclut les locations \u00e0 court terme ou assur\u00e9es, les locations commerciales et agricoles, et les locations qui d\u00e9pendent d'un emploi. Un locataire qui poss\u00e8de un bail de trois appartements ou plus dans l'immeuble est \u00e9galement exclu de la d\u00e9finition de \u201clocataire admissible\u201d.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">La loi de 1987 a une port\u00e9e tr\u00e8s large puisqu'elle s'applique aux \u201ccessions pertinentes\u201d, c'est-\u00e0-dire aux cessions par le propri\u00e9taire de tout bien ou int\u00e9r\u00eat dans les locaux (y compris tout bien ou int\u00e9r\u00eat dans les parties communes).<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Si les crit\u00e8res de qualification sont remplis, il est essentiel que les exigences de la loi de 1987 soient strictement respect\u00e9es.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Un propri\u00e9taire qui ne se conforme pas aux exigences de la loi de 1987 commet une infraction p\u00e9nale et peut \u00eatre condamn\u00e9 \u00e0 une amende. Les acheteurs doivent \u00e9galement savoir que le tribunal peut ordonner \u00e0 un acheteur de transf\u00e9rer son int\u00e9r\u00eat dans le terrain aux locataires si la loi de 1987 n'a pas
