Que faire si vous avez des doutes ?"},"content":{"rendered":"<h4 class=\"wp-block-heading\">MON CONTRAT EST-IL JURIDIQUEMENT CONTRAIGNANT ?<\/h4>\n\n\n\n<p>Une fois que vous avez accept\u00e9 l'offre et que les conditions auxquelles elle \u00e9tait soumise ont \u00e9t\u00e9 remplies, un accord juridiquement contraignant existe. Pour qu'un accord soit juridiquement contraignant, les conditions de formation d'un contrat doivent \u00eatre r\u00e9unies, \u00e0 savoir une offre, une acceptation, une intention de cr\u00e9er des relations juridiques et une contrepartie. Il se peut que vous ayez sign\u00e9 un contrat pour montrer que vous en acceptez les termes, mais les contrats peuvent aussi na\u00eetre de la communication verbale ou \u00e9lectronique de l'acceptation. Il est donc important de se rappeler qu'il n'est pas n\u00e9cessaire de signer pour qu'un contrat existe.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">JE NE VEUX PLUS ADH\u00c9RER. QUE DOIS-JE FAIRE ?<\/h4>\n\n\n\n<p>Que ce soit parce qu'une autre entreprise vous a propos\u00e9 un meilleur emploi ou parce que vous avez simplement chang\u00e9 d'avis, vous devez vous rappeler que vous avez conclu un contrat avec votre futur employeur. Vous devrez mettre fin \u00e0 ce contrat en respectant la p\u00e9riode de pr\u00e9avis stipul\u00e9e dans votre contrat de travail. Il est important d'examiner la clause de pr\u00e9avis figurant dans votre contrat de travail et de donner \u00e0 votre futur employeur un pr\u00e9avis conforme \u00e0 votre contrat.<\/p>\n\n\n\n<p>En pratique, il est bon que vous pr\u00e9veniez votre futur employeur d\u00e8s que possible afin qu'il puisse prendre d'autres dispositions. L'employeur aura investi du temps et des ressources en vous interviewant et en vous faisant une offre ; il est donc de bon ton (et poli) de le contacter pour lui expliquer la situation. Vous ne savez jamais quand vos chemins se croiseront \u00e0 nouveau.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">MON EMPLOYEUR PEUT-IL FAIRE QUELQUE CHOSE SI JE R\u00c9SILIE LE CONTRAT ?<\/h4>\n\n\n\n<p>Si vous ne donnez pas le pr\u00e9avis pr\u00e9vu par votre contrat de travail, vous serez en rupture de contrat. Votre futur employeur pourra \u00e9ventuellement intenter une action contre vous pour rupture de contrat. Toutefois, il devra prouver le pr\u00e9judice subi (s'il y en a un). Dans la plupart des cas, il est peu probable que l'employeur potentiel subisse un pr\u00e9judice, car vous n'avez pas encore commenc\u00e9 \u00e0 travailler. S'il a fait appel \u00e0 un agent de recrutement, il est probable que les conditions conclues avec l'agent stipulent que les frais de recrutement ne sont payables que lorsque vous avez commenc\u00e9 \u00e0 travailler ou apr\u00e8s avoir travaill\u00e9 pour l'employeur pendant une certaine p\u00e9riode.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">DOIS-JE PAYER QUELQUE CHOSE ?<\/h4>\n\n\n\n<p>Il est rare que les employeurs se retournent contre les salari\u00e9s qui d\u00e9cident de ne pas s'affilier apr\u00e8s avoir sign\u00e9. De leur point de vue, cela ne vaut g\u00e9n\u00e9ralement pas la peine de consacrer du temps et de l'argent \u00e0 une proc\u00e9dure judiciaire. Toutefois, la d\u00e9cision de votre futur employeur d'intenter ou non une action en justice d\u00e9pend en grande partie de l'existence d'un pr\u00e9judice quantifiable et de l'\u00e9tendue de ce pr\u00e9judice. Par exemple, l'employeur potentiel peut engager des frais pour vous remplacer ou peut avoir achet\u00e9 de nouveaux \u00e9quipements ou machines dans l'attente de votre arriv\u00e9e. Il peut s'agir d'une demande d'indemnisation pour pr\u00e9judice direct ou indirect.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">LES CLAUSES DE NON-PR\u00c9SENTATION SONT-ELLES L\u00c9GALES ?<\/h4>\n\n\n\n<p>Une clause de non-pr\u00e9sentation dans un contrat de travail est une clause qui stipule que vous devez payer une certaine somme d'argent au cas o\u00f9 vous ne commenceriez pas \u00e0 travailler avec votre futur employeur. Cette clause figure parfois dans les contrats des employ\u00e9s de tr\u00e8s haut niveau qui sont recrut\u00e9s pour remplir un r\u00f4le tr\u00e8s sp\u00e9cifique ou pour un projet particulier d'importance critique pour l'entreprise. Il est possible que la clause de non-pr\u00e9sentation soit une clause p\u00e9nale et qu'elle soit donc inapplicable. Il est \u00e9galement possible qu'une clause de non-pr\u00e9sentation constitue une entrave au commerce.<\/p>\n\n\n\n<p>Toutefois, il existe une jurisprudence qui sugg\u00e8re que, dans certaines circonstances, une clause de non-pr\u00e9sentation peut \u00eatre appliqu\u00e9e par votre employeur potentiel et constitue une clause de dommages-int\u00e9r\u00eats liquid\u00e9s. Le tribunal examinera les circonstances pour d\u00e9terminer si la clause est applicable.
