{"id":7402,"date":"2025-10-22T11:53:29","date_gmt":"2025-10-22T11:53:29","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=7402"},"modified":"2025-10-22T11:57:43","modified_gmt":"2025-10-22T11:57:43","slug":"victoire-du-tribunal-dappel-en-matiere-demploi","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/fr\/perspectives\/victoire-du-tribunal-dappel-en-matiere-demploi\/","title":{"rendered":"Victoire du Tribunal d'appel de l'emploi"},"content":{"rendered":"<p>L'\u00e9quipe de droit du travail de RFB a remport\u00e9 une victoire importante devant l'Employment Appeal Tribunal (\u2018EAT\u2019), en faisant appel avec succ\u00e8s d'une affaire qui renforce l'importance d'une \u00e9valuation juste et motiv\u00e9e dans les demandes de licenciement. <\/p>\n\n\n\n<p>En octobre 2023, le d\u00e9partement de l'emploi a repr\u00e9sent\u00e9 avec succ\u00e8s Jacqueline Davidson, une conductrice de v\u00e9hicule utilitaire, dans le cadre de sa plainte pour licenciement abusif contre National Express Limited. Mme Davidson avait \u00e9chou\u00e9 \u00e0 un alcootest sur le lieu de travail en raison de l'utilisation d'un rince-bouche \u00e0 base d'alcool dont le taux d'alcool\u00e9mie \u00e9tait sup\u00e9rieur \u00e0 la limite fix\u00e9e par l'entreprise, mais tout de m\u00eame trois fois sup\u00e9rieur \u00e0 la limite autoris\u00e9e.&nbsp;<strong><u>ci-dessous<\/u><\/strong>&nbsp;la limite nationale d'alcool au volant.  La limite nationale de conduite en \u00e9tat d'ivresse pour les conducteurs en Angleterre, au Pays de Galles et en Irlande du Nord est de 3,5 sur l'\u00e9thylom\u00e8tre. Mme Davidson a obtenu un r\u00e9sultat de 1,3, puis de 1,0 et enfin de 0,8 lors de trois tentatives successives effectu\u00e9es \u00e0 peu de temps d'intervalle. Apr\u00e8s avoir \u00e9chou\u00e9 au test, National Express Limited a n\u00e9anmoins permis \u00e0 Mme Davidson de conduire elle-m\u00eame jusqu'\u00e0 son domicile et l'a ensuite renvoy\u00e9e.<\/p>\n\n\n\n<p>Le London East Employment Tribunal (le \u2018Tribunal\u2019) a jug\u00e9 le licenciement abusif au motif que la proc\u00e9dure adopt\u00e9e au stade de l'appel \u00e9tait d\u00e9fectueuse et a major\u00e9 son indemnit\u00e9 compensatoire de 10% pour non-respect du code de l'ACAS. Toutefois, le tribunal a appliqu\u00e9 une r\u00e9duction de 75% pour Polkey et conduite contributive.<\/p>\n\n\n\n<p>Le d\u00e9partement de l'emploi de RFB a fait appel aupr\u00e8s de l'EAT, contestant l'importante r\u00e9duction compensatoire et l'absence de raisonnement pour limiter l'indemnisation \u00e0 l'\u00e2ge de 65 ans, Mme Davidson ayant d\u00e9clar\u00e9 qu'elle aurait pris sa retraite \u00e0 l'\u00e2ge de 70 ans. Mme Davidson a \u00e9galement fait appel de la conclusion de licenciement abusif.<\/p>\n\n\n\n<p>L'EAT a estim\u00e9 que le Tribunal avait commis une erreur dans l'\u00e9valuation des pertes, aux fins de l'octroi d'une indemnit\u00e9 compensatoire. Le Tribunal a limit\u00e9 le calcul sous-jacent de la perte de revenus futurs \u00e0 la p\u00e9riode allant jusqu'\u00e0 l'\u00e2ge de 65 ans, estimant que cela \u00e9tait juste et \u00e9quitable dans toutes les circonstances. Toutefois, l'EAT a estim\u00e9 que le Tribunal \u00e9tait tenu d'\u00e9valuer au mieux les pertes futures subies par Mme Davidson \u00e0 la suite du licenciement et imputables aux actions de National Express Limited. L'EAT a \u00e9galement not\u00e9 que le Tribunal n'avait pas tenu compte de la position de Mme Davidson selon laquelle elle devrait travailler jusqu'\u00e0 l'\u00e2ge de 70 ans.<\/p>\n\n\n\n<p>L'affaire a \u00e9t\u00e9 renvoy\u00e9e \u00e0 l'Employment Tribunal pour un nouvel examen.<\/p>\n\n\n\n<p>Cette d\u00e9cision est un rappel important que les tribunaux sont tenus d'\u00e9valuer la p\u00e9riode de perte en se r\u00e9f\u00e9rant \u00e0 toutes les preuves dont ils disposent et qu'ils ne peuvent pas se contenter de fixer l'\u00e2ge de la retraite sans justification.<\/p>\n\n\n\n<p>F\u00e9licitations \u00e0 Michael Michaeloudis et Tariro Carmel Nyoka, qui ont repr\u00e9sent\u00e9 le demandeur avec Saul Margo de Outer Temple Chambers.<\/p>\n\n\n\n<p><\/p>","protected":false},"author":12,"featured_media":7403,"parent":0,"menu_order":0,"template":"","format":"standard","meta":{"_acf_changed":false,"om_disable_all_campaigns":false,"_uf_show_specific_survey":0,"_uf_disable_surveys":false,"footnotes":""},"categories":[67],"tags":[],"class_list":["post-7402","insight","type-insight","status-publish","format-standard","has-post-thumbnail","hentry","category-employment"],"acf":[],"aioseo_notices":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
