The landscape is <a href=\"https:\/\/rfblegal.co.uk\/fr\/a-propos-de-nous\/\">about<\/a> to change. The Government\u2019s Renters\u2019 Rights <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/le-projet-de-loi-sur-les-droits-des-locataires-quels-sont-les-changements-apportes-par-les-syndicats\/\">Bill<\/a> (\u201cthe Bill\u201d) is in its final parliamentary stages and, once commenced, <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/un-testament-peut-il-annuler-mes-accords-anterieurs\/\">va<\/a> abolish Section 21 and move the sector to a single system of periodic tenancies with strengthened possession grounds under Section 8.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before we look ahead, it\u2019s vital to be clear about today\u2019s law. As at 22 August 2025, Section 21 remains in force. The Bill completed its House of Lords Third Reading on 21 July 2025 and will return to the House of Commons for <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/protection-de-la-contrepartie-differee-dans-le-cadre-dune-cession-dactions\/\">consideration<\/a> of Lords\u2019 amendments after summer recess in early September. Royal Assent is widely expected this <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/autumn-2025-budget-what-it-means-for-private-clients\/\">autumn<\/a>, with commencement likely in early 2026, but the exact start date has not yet been set.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>O\u00f9 en sommes-nous aujourd'hui : comment fonctionne l'article 21 (l\u00e9gislation actuelle)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A valid Section 21 notice (Form 6A) still gives a <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/guide-pour-les-bailleurs-commerciaux-lacceptation-dun-loyer-par-un-agent-equivaut-elle-a-une-renonciation-au-droit-de-confiscation\/\">landlord<\/a> a paperwork-led route to possession, often <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/orientations-concernant-les-demandes-de-licence-de-parrainage-au-royaume-uni-dans-le-cadre-du-visa-de-travailleur-qualifie\/\">via<\/a> the accelerated procedure (no hearing unless directed). To be valid, landlords must meet a checklist of <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/conseils-sur-les-nuisances-legales-pour-les-proprietaires-et-les-agents-de-gestion\/\">statutory<\/a> pre-conditions and time limits, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pr\u00e9avis minimum : au moins deux mois.<\/li>\n\n\n\n<li>Service le plus pr\u00e9coce : pas dans les 4 premiers mois de la location.<\/li>\n\n\n\n<li>En g\u00e9n\u00e9ral, la proc\u00e9dure doit \u00eatre engag\u00e9e dans les 6 mois suivant la notification (ou dans les 4 mois suivant l'expiration de l'avis si un avis plus long est requis).<\/li>\n\n\n\n<li>D\u00e9p\u00f4t : prot\u00e9ger le d\u00e9p\u00f4t et transmettre les informations prescrites.<\/li>\n\n\n\n<li><a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/guide-du-nouvel-exercice-financier-sassurer-que-les-documents-juridiques-de-son-entreprise-sont-a-jour\/\">Documents<\/a>: serve a valid gas safety certificate, <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/reglementation-de-lepc-pour-les-proprietes-commerciales-2025\/\">EPC<\/a>, and the current How to Rent guide (at the start\/ renewal, per the 2015 Regulations). Courts can still accept a late gas safety certificate provided it\u2019s given before the Section 21 notice (see <em>Maison Trecarrel<\/em>).<\/li>\n\n\n\n<li>Permis : d\u00e9tenir tout permis requis.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">On the accelerated track, a hearing only occurs if the judge directs one; otherwise the claim is determined on the papers. If landlords also seek <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/que-faire-si-votre-locataire-commercial-ne-paie-pas-son-loyer\/\">rent arrears<\/a>, they must use the <a href=\"https:\/\/rfblegal.co.uk\/fr\/rfbtermsof-business0625\/\">standard<\/a> route.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Pourquoi l'article 21 est-il aboli ?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;The policy driver is <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/qa-deferred-consideration-security\/\">security<\/a> of tenure: to remove the threat of arbitrary \u201cno-fault\u201d <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/peut-on-expulser-un-locataire-commercial-qui-ne-paie-pas-son-loyer\/\">eviction<\/a>, empower tenants to <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/le-recours-judiciaire-contre-la-reforme-du-droit-de-bail-remet-en-question-lavenir-de-dispositions-essentielles\/\">challenge<\/a> poor practice, and modernise renting standards. The Government\u2019s guide confirms the Bill abolishes Section 21 and replaces fixed terms with a single periodic system.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ce qui remplace l'article 21 dans le cadre du projet de loi sur les droits des locataires<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>One system of periodic tenancies: all assured tenancies will be periodic. Tenants can end the tenancy by giving two months\u2019 notice and landlords must rely on Section 8 grounds to recover possession. The <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/les-gouvernements-repondent-aux-arrieres-de-loyers-commerciaux-de-covid\/\">Government<\/a> intends to implement this in one stage, rather than phasing.<\/li>\n\n\n\n<li>Motifs \u00e9largis et clarifi\u00e9s pour l'article 8 : le projet de loi conserve une approche fond\u00e9e sur les motifs (obligatoires et discr\u00e9tionnaires), mais l'actualise et l'\u00e9largit. Les principales propositions sont les suivantes<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Le propri\u00e9taire vend ou emm\u00e9nage : motifs expr\u00e8s pour recouvrer la possession afin de vendre ou pour que le propri\u00e9taire (ou sa famille proche) emm\u00e9nage. Il existe une p\u00e9riode de protection de 12 mois au d\u00e9but d'une location pendant laquelle ces motifs ne peuvent \u00eatre utilis\u00e9s, et les propri\u00e9taires doivent donner un pr\u00e9avis de quatre mois lorsqu'ils s'en pr\u00e9valent.<\/li>\n\n\n\n<li>Serious rent <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/arrieres-de-loyer-commercial-guide-pratique-a-lintention-des-locataires-commerciaux\/\">arrears<\/a> (ground 8): threshold increased to three months\u2019 arrears and the notice period for arrears grounds extended to four weeks.<\/li>\n\n\n\n<li>Arri\u00e9r\u00e9s r\u00e9p\u00e9t\u00e9s : un nouveau motif obligatoire pour les locataires qui ont accumul\u00e9 deux mois d'arri\u00e9r\u00e9s \u00e0 trois reprises en l'espace de trois ans, m\u00eame s'ils ont \u00e9t\u00e9 blanchis lors de l'audience.<\/li>\n\n\n\n<li>Back-door <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/article-1-le-projet-de-loi-sur-la-reforme-des-locataires-la-fin-des-expulsions-sans-faute-en-vertu-de-larticle-21-et-un-nouveau-motif-de-possession\/\">evictions<\/a>: safeguards against using above-market rent increases to force tenants out, with Tribunal oversight<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wider reforms alongside possession: the Bill also introduces a PRS Ombudsman, a <a href=\"https:\/\/rfblegal.co.uk\/fr\/base-de-connaissances\/client-prive\/\">Private<\/a> Rented Sector <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/la-base-de-donnees-prs-le-mediateur-pour-les-proprietaires\/\">Database<\/a>, restrictions on rental bidding, strengthened Decent Homes obligations, and pet requests that cannot be unreasonably refused (with permitted pet-damage insurance).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Veuillez noter que ces mesures ne sont pas encore en vigueur et que les derniers d\u00e9tails pourraient encore changer avant la sanction royale et l'entr\u00e9e en vigueur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Calendrier : Quand l'article 21 prendra-t-il fin ?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">21 juillet 2025 : Troisi\u00e8me lecture du projet de loi aux Lords<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D\u00e9but septembre 2025 : Retour aux Communes pour examen des amendements des Lords<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sanction royale : Largement attendue \u00e0 l'automne 2025 (non confirm\u00e9e)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D\u00e9but : D\u00e9marrage unique pr\u00e9vu d\u00e9but 2026 (le gouvernement indique une mise en \u0153uvre en une seule \u00e9tape, mais n'a pas fix\u00e9 la date).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jusqu'\u00e0 l'entr\u00e9e en vigueur de la loi, les propri\u00e9taires peuvent toujours se pr\u00e9valoir de l'article 21, \u00e0 condition que toutes les conditions soient remplies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ce que cela signifie en pratique<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Pour les propri\u00e9taires<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No more Section 21: plan to proceed under Section 8. The accelerated Section 21 route will fall away and most <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/reclamations-pour-vetuste-guide-a-lusage-des-proprietaires-de-logements-prives\/\">claims<\/a> will run on the standard track with <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/section-28-lutilisation-croissante-de-preuves-preenregistrees-dans-les-proces-penaux-partie-2\/\">evidence<\/a> and (usually) a hearing.<\/li>\n\n\n\n<li>Nouvelle vente ou nouvel emm\u00e9nagement : si vous avez l'intention de vendre ou d'emm\u00e9nager, le projet de loi pr\u00e9voit des motifs pour le faire, mais seulement apr\u00e8s 12 mois et avec un pr\u00e9avis de quatre mois. \u00c9tablissez des calendriers en fonction de ces contraintes.<\/li>\n\n\n\n<li>Arrears strategy: ensure ledgers are meticulous. The higher Ground 8 threshold (3 months) and repeated-arrears ground will shape case selection and <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/onlyfans-et-contrats-limportance-du-timing\/\">timing<\/a>.<\/li>\n\n\n\n<li>Compliance: expect sharper <a href=\"https:\/\/rfblegal.co.uk\/fr\/base-de-connaissances\/le-controle-judiciaire-dans-le-secteur-des-services-financiers\/\">scrutiny<\/a> of licensing and documents once live.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Pour les locataires<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Greater security: a <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/pret-relais-en-souffrance-que-se-passe-t-il-si-vous-ne-pouvez-pas-rembourser-un-pret-relais-a-temps\/\">default<\/a> periodic tenancy and the end of \u201cno-fault\u201d eviction.<\/li>\n\n\n\n<li>Avis et garanties : plus de temps lorsque les propri\u00e9taires cherchent \u00e0 obtenir la possession du logement pour le vendre ou l'habiter. Possibilit\u00e9 de contester les augmentations de loyer excessives destin\u00e9es \u00e0 forcer la sortie.<\/li>\n\n\n\n<li>L'expulsion reste possible : des arri\u00e9r\u00e9s de loyer graves ou persistants, un comportement antisocial et d'autres motifs peuvent toujours justifier l'expulsion.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Mesures pratiques \u00e0 prendre d\u00e8s maintenant<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Propri\u00e9taires<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Audit paperwork on <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/la-loi-de-2025-sur-les-droits-des-locataires-ce-que-tout-proprietaire-doit-savoir\/\">every<\/a> AST: deposit compliance, gas safety, EPC, How to Rent Guide, licences. Defects derail Section 21 under current legislation, and weaken credibility under Section 8.<\/li>\n\n\n\n<li>Planifiez les cessions : si vous vendez, int\u00e9grez dans votre calendrier la p\u00e9riode de protection de 12 mois et le pr\u00e9avis de quatre mois.<\/li>\n\n\n\n<li>Protocoles relatifs aux arri\u00e9r\u00e9s : agir rapidement en cas d'arri\u00e9r\u00e9s, documenter minutieusement et calibrer les demandes en fonction du seuil de 3 mois\/du nouveau motif d'arri\u00e9r\u00e9s r\u00e9p\u00e9t\u00e9s.<\/li>\n\n\n\n<li>Il faut s'attendre \u00e0 un plus grand nombre de contestations de possession : organiser les preuves, les dossiers d'inspection et les registres de r\u00e9paration.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Locataires<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Conservez des archives : signalez les probl\u00e8mes de r\u00e9paration par \u00e9crit et conservez une trace \u00e9crite.<\/li>\n\n\n\n<li>Conna\u00eetre l'heure : si vous recevez une notification au titre de l'article 21 avant l'ouverture de la proc\u00e9dure, les r\u00e8gles actuelles en mati\u00e8re de notification, de d\u00e9lais et de moyens de d\u00e9fense restent d'application. Demandez conseil rapidement.<\/li>\n\n\n\n<li>Budget: arrears will remain a strong ground post-reform. For landlords, <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/succes-du-tribunal-du-travail-licenciement-abusif-et-injustifie\/\">success<\/a> will turn on compliance and evidence under Section 8, particularly for arrears and sale\/ move-in grounds.
