{"id":5696,"date":"2025-01-31T10:56:58","date_gmt":"2025-01-31T10:56:58","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=5696"},"modified":"2025-04-29T13:29:18","modified_gmt":"2025-04-29T13:29:18","slug":"mises-a-jour-et-defis-de-la-reforme-de-laffranchissement-collectif-de-la-prolongation-du-bail","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/fr\/perspectives\/mises-a-jour-et-defis-de-la-reforme-de-laffranchissement-collectif-de-la-prolongation-du-bail\/","title":{"rendered":"Mises \u00e0 jour et d\u00e9fis de la r\u00e9forme de la prolongation des baux et de l'affranchissement collectif"},"content":{"rendered":"<h2 class=\"wp-block-heading\"><strong>Suppression de la r\u00e8gle des deux ans<\/strong>\u00a0<\/h2>\n\n\n\n<p>Le d\u00e9c\u00e8s de <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2024\/22#:~:text=An%20Act%20to%20prohibit%20the,manage%20the%20buildings%20containing%20their\">Loi de 2024 sur la r\u00e9forme des baux et de la pleine propri\u00e9t\u00e9 (LFRA 2024)<\/a> a \u00e9t\u00e9 consid\u00e9r\u00e9 comme le point de d\u00e9part de la r\u00e9forme tant attendue concernant la prolongation des baux, l'accession collective \u00e0 la propri\u00e9t\u00e9 et le droit de gestion. Il faut reconna\u00eetre que les r\u00e9formes propos\u00e9es \u00e9taient largement favorables aux locataires, dont voici quelques-uns des points cl\u00e9s :\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Supprimer l'obligation pour le locataire d'\u00eatre propri\u00e9taire depuis au moins deux ans pour pouvoir entamer la proc\u00e9dure ;\u00a0<\/li>\n\n\n\n<li>Passer la dur\u00e9e minimale de 90 ans \u00e0 pas moins de 990 ans ;\u00a0<\/li>\n\n\n\n<li>Supprimer l'obligation pour le locataire de payer la \u2018 valeur de mariage \u2019 ;\u00a0<\/li>\n\n\n\n<li>Priver le propri\u00e9taire de la possibilit\u00e9 de se faire rembourser ses frais par le locataire dans la plupart des cas.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Toutefois, la loi LFRA 2024 ne pr\u00e9cisait ni date d'entr\u00e9e en vigueur ni modalit\u00e9s de fonctionnement du nouveau r\u00e9gime, ce qui a conduit \u00e0 la n\u00e9cessit\u00e9 d'adopter des textes r\u00e9glementaires pour mettre en \u0153uvre les modifications propos\u00e9es.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Des rumeurs laissaient toutefois entendre que ces r\u00e9formes favorables aux locataires seraient contest\u00e9es par les grands groupes immobiliers, qui y verraient une atteinte potentielle \u00e0 leurs droits fondamentaux, dans la mesure o\u00f9 la suppression des indemnit\u00e9s de plus-value risquerait de faire dispara\u00eetre des millions de livres du march\u00e9 immobilier sans aucune compensation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Lors du discours du Tr\u00f4ne, le Parti travailliste a confirm\u00e9 que certaines des modifications propos\u00e9es n\u00e9cessiteraient davantage de temps d'examen, mais que d'autres, plus faciles \u00e0 mettre en \u0153uvre, pourraient \u00eatre trait\u00e9es dans un d\u00e9lai plus court.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00c0 cette fin, le premier r\u00e8glement d'entr\u00e9e en vigueur a d\u00e9sormais \u00e9t\u00e9 adopt\u00e9 ; il vise \u00e0 supprimer purement et simplement l'obligation de d\u00e9tention de deux ans \u00e0 compter du <strong>Vendredi 31 janvier 2025<\/strong> pour la prolongation des baux d'appartements.&nbsp;<\/p>\n\n\n\n<p>Cette mesure aura \u00e9galement pour effet de supprimer, \u00e0 compter de cette m\u00eame date, la possibilit\u00e9 pour les repr\u00e9sentants personnels de signifier des notifications au nom d'un propri\u00e9taire l\u00e9gal d\u00e9c\u00e9d\u00e9.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Cela aura des r\u00e9percussions sur la mani\u00e8re dont les professionnels g\u00e8rent les prolongations de bail, en particulier lorsque l'appartement fait l'objet d'une vente imminente.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contr\u00f4le juridictionnel de la LFRA 2024<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Ironiquement, la veille de la mise en \u0153uvre de la premi\u00e8re mesure susmentionn\u00e9e, le 30 janvier 2025, une audience devant la Cour royale de justice a accord\u00e9 \u00e0 un groupe de six propri\u00e9taires l'autorisation, pour tous les motifs invoqu\u00e9s, de demander un contr\u00f4le juridictionnel de la LFRA 2024 au motif qu'elle est incompatible avec la loi de 1998 sur les droits de l'homme.&nbsp;<\/p>\n\n\n\n<p>L'audience au fond devrait avoir lieu vers juillet 2025. Cela jette un doute suppl\u00e9mentaire de taille sur les modifications propos\u00e9es et sur la question de savoir si elles seront un jour mises en \u0153uvre.&nbsp;&nbsp;<\/p>\n\n\n\n<p>On comprend ais\u00e9ment \u00e0 quel point la suppression de la valeur du mariage et la d\u00e9pr\u00e9ciation consid\u00e9rable du portefeuille immobilier d'un propri\u00e9taire pourraient porter atteinte au droit \u00e0 la propri\u00e9t\u00e9 ; nous attendrons donc le verdict avec impatience.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nous contacter<\/strong>&nbsp;<\/h2>\n\n\n\n<p>On constate que ce domaine est en constante \u00e9volution.
