What is a freezing injunction<\/a>? In simple terms, it’s a powerful legal tool allowing an Applicant (typically the Claimant) to safeguard the value of the Respondent\u2019s assets until a judgment is obtained against them. <\/p>\n\n\n\n

Upon initial success<\/a> of the application, the court va<\/a> order that the Respondent\u2019s assets cannot be disposed of, dealt with, or diminished. This order will then be relayed by the Applicant to major banks, prompting them to freeze any accounts held under the Respondent\u2019s name. <\/p>\n\n\n\n

Dans la plupart des cas, la demande d'injonction de gel et l'audience initiale se d\u00e9roulent sans que le d\u00e9fendeur soit pr\u00e9sent ou conscient. Comment surmonter une injonction de gel ? <\/strong><\/p>\n\n\n\n

Lors de l'audience initiale, \u00e0 laquelle le d\u00e9fendeur n'assiste g\u00e9n\u00e9ralement pas, le juge fixe une nouvelle audience, g\u00e9n\u00e9ralement une \u00e0 deux semaines plus tard. Date de retour<\/em>. Cela permet au d\u00e9fendeur de contester l'injonction de gel et de pr\u00e9senter des arguments en faveur de sa suppression. <\/p>\n\n\n\n

Pour surmonter une injonction de gel, il faut tenir compte de plusieurs facteurs essentiels, qui sont souvent d\u00e9terminants pour la lev\u00e9e de l'injonction : <\/p>\n\n\n\n

- Action rapide<\/strong>: Le temps presse, car il ne reste que quelques jours avant la date de retour. Il est donc essentiel d'engager rapidement une repr\u00e9sentation juridique. L'opposition \u00e0 une injonction de gel est complexe et il est essentiel de demander rapidement l'aide d'avocats comp\u00e9tents. <\/p>\n\n\n\n

– Full and Frank Divulgation<\/a><\/strong>: Since the Respondent cannot defend themselves initially, the Applicant must provide full and frank disclosure of any evidence<\/a> during the first hearing. Scrutinising the application documents<\/a> meticulously for evidence of full and frank disclosure or lack thereof is essential. Non-compliance with this duty can be grounds for the freezing injunction to be discharged. <\/p>\n\n\n\n

- D\u00e9monstration d'un faible risque de dissipation des actifs<\/strong>: L'injonction de gel est souvent accord\u00e9e sur la base d'un risque de dilapidation des actifs. Cependant, la pr\u00e9sentation de preuves du contraire peut influencer le tribunal. - Pas de \u2018bon cas d\u00e9fendable\u2019.\u2019<\/strong>: Si, \u00e0 la date de retour, vous pouvez d\u00e9montrer que la demande sous-jacente du requ\u00e9rant n'est pas fond\u00e9e et qu'il est peu probable qu'elle aboutisse au proc\u00e8s, vous disposez d'un argument solide en faveur de la lev\u00e9e de l'injonction de gel. <\/p>\n\n\n\n

- Ajourner la date de retour si n\u00e9cessaire<\/strong>: 1 – 2 weeks will often not be long enough for you to be fully prepared for the Return Date hearing. You only get one chance at the Return Date hearing, if you are unsuccessful, you will need to show in any future application to discharge the injunction that there has been a material change in circumstances since the Return Date.  Often the time provided by the Court for the Return Date will be insufficient if the parties are to argue whether the freezing injunction should continue. Requesting an adjournment to a later date can provide suppl\u00e9mentaires<\/a> time to address the accusations made by the Applicant effectively. <\/p>\n\n\n\n

Freezing Injonctions<\/a>: Damages <\/strong><\/p>\n\n\n\n

The Applicant will need to provide the court with an undertaking (promise) to pay any damages incurred as a result of the freezing injunction, should the freezing injunction be discharged at the return date or trial. It is therefore crucial to keep accurate records of losses incurred, such as loss of business<\/a>. <\/p>\n\n\n\n
