Where a landlord wants to serve a section 8 notice they must demonstrate that one of the grounds for possession applies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Section 21 of the Housing Act 1988 enables <a href=\"https:\/\/rfblegal.co.uk\/fr\/base-de-connaissances\/client-prive\/\">private<\/a> landlords to repossess their properties from assured shorthold tenants (ASTs) at the end of the fixed term without having to establish fault on the part of the tenant (subject to private landlords having complied with the <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/visas-uk-2024-le-salaire-minimum-et-les-exigences-en-matiere-de-revenus\/\">requirements<\/a> for <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/servir-la-justice-en-utilisant-la-loi-sur-les-societes-pour-la-notification-effective-de-lenregistrement-dun-jugement-de-lile-de-man\/\">en service<\/a> a section 21 notice). Hence it is sometimes referred to as the \u2018no-fault\u2019 ground for <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/peut-on-expulser-un-locataire-commercial-qui-ne-paie-pas-son-loyer\/\">eviction<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-lg-font-size\"><strong>A<\/strong>Suppression des expulsions en vertu de l'article 21<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">The Government have now confirmed that, through the Renters Reform Bill, section 21 <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/avis-au-titre-de-larticle-146-guide-pour-les-bailleurs-commerciaux\/\">notices<\/a> <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/un-testament-peut-il-annuler-mes-accords-anterieurs\/\">va<\/a> be abolished. This may present a problem to private landlords who are looking to sell their property and need vacant possession in order to do so. If, for instance, the tenant in situ has not committed any <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/ce-que-tout-bailleur-commercial-doit-savoir-sur-les-ruptures-de-contrat-de-location\/\">breaches<\/a> of the tenancy <a href=\"https:\/\/rfblegal.co.uk\/fr\/base-de-connaissances\/ai-je-besoin-dune-convention-dactionnaires\/\">agreement<\/a> \/ the landlord cannot satisfy any of the grounds for possession under section 8, without the section 21 procedure at their disposal, on the face of it, a landlord may face difficulties obtaining vacant possession of a property if there are no grounds for possession under Section 8.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-lg-font-size\">Nouveau motif obligatoire permettant aux propri\u00e9taires souhaitant vendre leur bien immobilier de r\u00e9cup\u00e9rer la possession de celui-ci<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Toutefois, le gouvernement a annonc\u00e9 qu'un nouveau motif d'expulsion serait ajout\u00e9 \u00e0 la proc\u00e9dure pr\u00e9vue \u00e0 l'article 8, permettant ainsi aux propri\u00e9taires d'expulser leurs locataires s'ils ont l'intention de vendre le bien immobilier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le gouvernement a confirm\u00e9 que le nouveau motif pr\u00e9vu \u00e0 l'article 8 sera un motif \u2018 obligatoire \u2019, ce qui signifie que si un juge estime que ce motif est \u00e9tabli, la restitution du bien doit \u00eatre accord\u00e9e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">However, even with the addition of this new ground, the abolition of the section 21 procedure (and presumably, the accelerated possession procedure) could result in significant <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/injonctions-de-gel-delais-et-obligation-de-divulgation-complete-et-franche\/\">delays<\/a> for landlords obtaining possession of their property. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">There is also a possibility that the Government will introduce a requirement that all section 8 notices become subject to the requirement that the deposit must have been protected in a Government authorised scheme and the prescribed information served. At this stage, it is also not yet clear whether the other requirements which apply to the service of a section 21 possession procedure (<a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/reglementation-de-lepc-pour-les-proprietes-commerciales-2025\/\">EPC<\/a>, Gas Safety Certificate and How to Rent Guide) will also be imposed on the section 8 possession procedure.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-lg-font-size\">\u00c9l\u00e9ments de preuve requis pour d\u00e9montrer l'intention de vendre<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">As yet, it is unclear what <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/section-28-lutilisation-croissante-de-preuves-preenregistrees-dans-les-proces-penaux-partie-2\/\">evidence<\/a> will be required on the part of landlords to prove that they are intending to sell the Property. The Renters Reform Bill will elaborate in due course; however it is unclear whether simply listing the Property for sale will be enough to satisfy this ground. The problem with this is that seemingly, once having been granted vacant possession a Landlord could simply take the Property off the market and grant a new tenancy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">La r\u00e9ponse du gouvernement \u00e0 la consultation sur la proc\u00e9dure pr\u00e9vue \u00e0 l'article 21 pr\u00e9cise toutefois clairement que le d\u00e9lai de pr\u00e9avis pour ce nouveau motif serait de deux mois et qu'aucun pr\u00e9avis ne pourrait \u00eatre donn\u00e9 au cours des six premiers mois d'un nouveau bail. La r\u00e9ponse indique \u00e9galement qu'\u00e0 titre de mesure de protection, le gouvernement&nbsp;<em>\u201cprevent the original landlord <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/le-marketing-des-memes-les-responsables-des-medias-sociaux-doivent-se-mefier-des-pieges-juridiques\/\">marketing<\/a> and reletting the Property for 3 months following the use of this ground.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le livre blanc pr\u00e9cise \u00e9galement que les propri\u00e9taires cherchant \u00e0 exploiter des failles&nbsp;<em>\u201c ne sera pas tol\u00e9r\u00e9 \u201d<\/em>&nbsp;et le gouvernement examine actuellement la n\u00e9cessit\u00e9 de&nbsp;<em>\u201cnew or strengthened penalties to <a href=\"https:\/\/rfblegal.co.uk\/fr\/etiquette\/support-staff\/\">assistance<\/a> existing measures, including the power for councils to issue <a href=\"https:\/\/rfblegal.co.uk\/fr\/meditation-civile\/\">Civil<\/a> Penalties Notices for offences related to the new tenancy system. We will also explore how to help local councils tackling <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/civil-penalties-for-illegal-working\/\">illegal<\/a> <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/loi-sur-les-droits-des-locataires-2025-expulsions-apres-le-1er-mai-2026\/\">evictions<\/a>.\u201d<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-lg-font-size\">Conclusion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">It seems clear that the future of evictions is set to change quite considerably. It would seem that along with abolishing the section 21 notice, so too will the accelerated possession procedure be <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/lavenir-de-limpot-sur-les-successions-supprime-ou-reforme\/\">scrapped<\/a>. For private landlords with relatively straightforward possession <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/reclamations-pour-vetuste-guide-a-lusage-des-proprietaires-de-logements-prives\/\">claims<\/a>, this may cause delays in obtaining possession of their properties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">This is not the only change proposed by the Renters Reform Bill. It also proposes to create a register of landlords, introduce a private rented ombudsman to deal with landlord and <a href=\"https:\/\/rfblegal.co.uk\/fr\/services\/droit-des-affaires\/contentieux-immobilier-affaires\/\">tenant disputes<\/a>, to make it illegal for landlords and agents to refuse applications for tenancies from prospective tenants on the basis that they are in receipt of benefits and will grant further powers to local authorities to protect and enforce renters\u2019 rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">RFB will publish further articles on these proposed changes over the coming months.
