Vous pouvez lire le r\u00e9sultat de l'arr\u00eat de la Cour d'appel dans notre nouvel article. <a href=\"https:\/\/rfblegal.co.uk\/fr\/perspectives\/le-taux-dinteret-par-defaut-dun-preteur-relais-constitue-t-il-une-penalite-inapplicable\/\">\u201cPr\u00eats relais - Le taux d'int\u00e9r\u00eat par d\u00e9faut d'un pr\u00eateur relais constitue-t-il une p\u00e9nalit\u00e9 inapplicable ?\u201d<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><em>Dans une affaire r\u00e9cente, la Haute Cour a estim\u00e9 qu'un taux d'int\u00e9r\u00eat par d\u00e9faut de 4% dans un contrat de pr\u00eat \u00e0 court terme garanti par une propri\u00e9t\u00e9 r\u00e9sidentielle constituait une p\u00e9nalit\u00e9 et \u00e9tait inapplicable.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>Les garanties et les conditions du pr\u00eat<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le pr\u00eateur (L) a pr\u00eat\u00e9 1,9 million de livres sterling \u00e0 une autre soci\u00e9t\u00e9, d\u00e9tenue par H et N, garantie par des hypoth\u00e8ques sur divers biens immobiliers, dont leur maison familiale et cinq biens en location-vente.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le contrat de pr\u00eat pr\u00e9voyait qu'en cas de violation substantielle, L pouvait nommer un administrateur judiciaire, vendre les biens immobiliers et imposer une amende de 1,5 million d'euros.&nbsp;<em>4% par mois<\/em>&nbsp;taux d'int\u00e9r\u00eat de retard en cas de violation substantielle.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>D\u00e9terminer si un taux d'int\u00e9r\u00eat par d\u00e9faut constitue une p\u00e9nalit\u00e9<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Le taux d'int\u00e9r\u00eat mensuel par d\u00e9faut de 4%, a&nbsp;<em>quadruple<\/em>&nbsp;du taux normal, s'est av\u00e9r\u00e9e \u00eatre une p\u00e9nalit\u00e9 inapplicable. Appliquer&nbsp;<em>t<\/em>es principes de l'affaire<em>&nbsp;<a href=\"https:\/\/www.supremecourt.uk\/cases\/uksc-2013-0280.html\"><strong>El Makdessi \/ Cavendish Square Holdings BV<\/strong><\/a><\/em>, La question centrale pour d\u00e9terminer si un taux d'int\u00e9r\u00eat par d\u00e9faut est une p\u00e9nalit\u00e9 est la suivante&nbsp;<em>si l'ampleur de l'augmentation s'explique de mani\u00e8re satisfaisante par la protection d'un int\u00e9r\u00eat l\u00e9gitime<\/em>. Si, en principe, l'application d'un taux plus \u00e9lev\u00e9 en cas de d\u00e9faillance peut se justifier commercialement en raison d'un risque de cr\u00e9dit accru pour l'emprunteur, il est douteux que L. puisse se pr\u00e9valoir de ce droit dans le cas pr\u00e9sent.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Pourquoi des taux de d\u00e9faut plus \u00e9lev\u00e9s ne peuvent-ils pas \u00eatre justifi\u00e9s ?<\/strong><\/h2>\n\n\n\n<p>Les probl\u00e8mes de cr\u00e9dit de H et N auraient pu l\u00e9gitimement amener un pr\u00eateur \u00e0 les consid\u00e9rer comme un risque plus \u00e9lev\u00e9. Toutefois, d'autres facteurs doivent \u00eatre pris en compte :<br><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">1. L avait d\u00e9j\u00e0 tarif\u00e9 une augmentation pour refl\u00e9ter le risque de cr\u00e9dit suppl\u00e9mentaire, en faisant passer le taux de 0,7% \u00e0 1% pour tenir compte d'un jugement \u00e0 l'encontre de N. L n'a fourni aucune preuve de la raison pour laquelle le retard de paiement justifiait une augmentation de 3% suppl\u00e9mentaires alors qu'une augmentation de 0,3% avait \u00e9t\u00e9 suffisante par rapport au taux standard pour tenir compte de la solvabilit\u00e9.<br>2. Le m\u00eame niveau d'int\u00e9r\u00eats moratoires est appliqu\u00e9 quelle que soit la nature du manquement.<br>3. Le taux de d\u00e9faillance a \u00e9t\u00e9 fix\u00e9 de mani\u00e8re centralis\u00e9e par L, ce qui signifie qu'il n'a pas pu \u00eatre fix\u00e9 en fonction des risques sp\u00e9cifiques de l'emprunteur ou du pr\u00eat en question.
