Qu\u00e9 hacer si te arrepientes"},"content":{"rendered":"<h4 class=\"wp-block-heading\">\u00bfES MI CONTRATO JUR\u00cdDICAMENTE VINCULANTE?<\/h4>\n\n\n\n<p>Una vez que haya aceptado la oferta y se hayan cumplido las condiciones a las que estaba sujeta, existir\u00e1 un acuerdo jur\u00eddicamente vinculante. Para que un acuerdo sea jur\u00eddicamente vinculante, deben cumplirse las condiciones para la formaci\u00f3n de un contrato, es decir, debe haber una oferta, una aceptaci\u00f3n, la intenci\u00f3n de crear relaciones jur\u00eddicas y una contraprestaci\u00f3n. Es posible que haya firmado un contrato para mostrar su aceptaci\u00f3n de las condiciones, pero los contratos tambi\u00e9n pueden existir comunicando la aceptaci\u00f3n verbal o electr\u00f3nicamente, por lo que es importante recordar que no es necesario firmar para que exista un contrato.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">YA NO QUIERO AFILIARME. \u00bfQU\u00c9 HAGO?<\/h4>\n\n\n\n<p>Tanto si te han ofrecido un trabajo mejor en otra empresa como si has cambiado de opini\u00f3n, debes recordar que has firmado un contrato con tu futuro empleador. Deber\u00e1 rescindir el contrato cumpliendo el plazo de preaviso estipulado en su contrato de trabajo. Es importante que consultes la cl\u00e1usula de preaviso de tu contrato de trabajo y, a continuaci\u00f3n, avises a tu futuro empresario conforme a lo estipulado en el contrato.<\/p>\n\n\n\n<p>En la pr\u00e1ctica, es bueno que avises a tu posible empleador lo antes posible para que pueda tomar medidas alternativas. El empresario habr\u00e1 invertido tiempo y recursos en entrevistarte y hacerte una oferta, as\u00ed que es una buena pr\u00e1ctica (y de buena educaci\u00f3n) ponerse en contacto con \u00e9l para explicarle la situaci\u00f3n. Nunca se sabe cu\u00e1ndo volver\u00e1n a cruzarse sus caminos.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u00bfPUEDE HACER ALGO MI EMPRESARIO SI DESISTO DEL CONTRATO?<\/h4>\n\n\n\n<p>Si no entrega el preaviso exigido en su contrato de trabajo, estar\u00e1 incumpliendo el contrato. Su futuro empleador podr\u00e1 interponer una demanda contra usted por incumplimiento de contrato. Sin embargo, deber\u00e1 demostrar el perjuicio (si es que lo hay). En la mayor\u00eda de los casos, es improbable que el posible empresario sufra ning\u00fan perjuicio porque usted a\u00fan no ha empezado a trabajar. Si han recurrido a un agente de contrataci\u00f3n, es probable que las condiciones con el agente estipulen que la comisi\u00f3n de contrataci\u00f3n s\u00f3lo se pagar\u00e1 cuando hayas empezado a trabajar o despu\u00e9s de haber estado con el empleador durante un determinado periodo de tiempo.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u00bfTENDR\u00c9 QUE PAGAR ALGO?<\/h4>\n\n\n\n<p>Es raro que los empresarios reclamen a los empleados que deciden no afiliarse despu\u00e9s de firmar. Desde su punto de vista, no suele merecer la pena invertir el tiempo y los gastos de un procedimiento judicial. Sin embargo, la decisi\u00f3n de su futuro empleador sobre si presentar o no una demanda depende en gran medida de si se ha producido alguna p\u00e9rdida cuantificable y de la magnitud de la misma. Por ejemplo, el posible empleador puede incurrir en gastos para encontrarle un sustituto o puede haber comprado nuevos equipos o maquinaria a la espera de su llegada. Podr\u00eda haber una reclamaci\u00f3n por da\u00f1os directos o indirectos.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u00bfSON LEGALES LAS CL\u00c1USULAS DE \u2018NO COMPARECENCIA\u2019?<\/h4>\n\n\n\n<p>Una cl\u00e1usula de no presentaci\u00f3n en un contrato de trabajo es aquella que establece que tienes que pagar una determinada cantidad de dinero en caso de que no empieces a trabajar con tu futuro empleador. A veces se ve en los contratos de empleados de muy alto nivel contratados para desempe\u00f1ar una funci\u00f3n muy espec\u00edfica o para un proyecto empresarial cr\u00edtico. Es posible que la cl\u00e1usula de no presentaci\u00f3n sea una cl\u00e1usula penal y, por tanto, no pueda aplicarse. Tambi\u00e9n existe el argumento de que una cl\u00e1usula de no presentaci\u00f3n constituye una restricci\u00f3n del comercio.<\/p>\n\n\n\n<p>Sin embargo, hay jurisprudencia que sugiere que, en determinadas circunstancias, una cl\u00e1usula de no comparecencia podr\u00e1 ser aplicada por su posible empleador y ser\u00e1 una cl\u00e1usula de indemnizaci\u00f3n por da\u00f1os y perjuicios.
