Sin embargo, dado que los pr\u00e9stamos puente se caracterizan por plazos de vencimiento cortos y tipos de inter\u00e9s elevados, tambi\u00e9n presentan una alta tasa de impago. Cuando un prestatario no consigue saldar la deuda a tiempo, los prestamistas de puente suelen eludir los largos tr\u00e1mites judiciales y nombran inmediatamente a administradores judiciales en virtud de la garant\u00eda real o de la Ley de la Propiedad (LPA) para embargar y vender el inmueble pignorado.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hist\u00f3ricamente, una paradoja operativa ralentiz\u00f3 esta v\u00eda de ejecuci\u00f3n cuando se trataba de viviendas ocupadas por sus propietarios. Seg\u00fan las condiciones hipotecarias habituales, los administradores judiciales est\u00e1n designados legalmente como representantes del prestatario para proteger al prestamista de cualquier responsabilidad. Esto plante\u00f3 una cuesti\u00f3n jur\u00eddica compleja:&nbsp;<em>\u00bfC\u00f3mo puede un agente demandar a su propio mandante para reclamar la posesi\u00f3n del inmueble?<\/em>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El caso hist\u00f3rico del Tribunal Superior de&nbsp;<a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/w-022-3603?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true\"><em>Menon contra Pask&nbsp;<\/em>2019<em>&nbsp;<\/em>EWHC 2611 (Ch)<em>&nbsp;<\/em><\/a>ha resuelto este dilema que se ven\u00eda arrastrando desde hac\u00eda tiempo.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">El funcionamiento de la administraci\u00f3n judicial en la financiaci\u00f3n puente&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Para comprender la importancia de la sentencia del caso Menon contra Pask, conviene analizar por qu\u00e9 los prestamistas prefieren recurrir a administradores judiciales en los litigios relacionados con los pr\u00e9stamos puente.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cuando un prestatario incumple el pago de un pr\u00e9stamo puente, el principal objetivo del prestamista es recuperar su capital lo antes posible. Vender una vivienda con inquilinos o con el propietario a\u00fan viviendo en ella reduce su valor de mercado y retrasa la transacci\u00f3n.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Las entidades crediticias se basan en el <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/Geo5\/15-16\/20\/contents\">Ley de Propiedad de 1925<\/a> y establecer condiciones hipotecarias que permitan nombrar administradores judiciales. Este enfoque ofrece claras ventajas:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Exenci\u00f3n de responsabilidad:<\/strong>&nbsp;Dado que el receptor act\u00faa como agente del prestatario, el prestamista evita ser considerado un \u201cacreedor hipotecario en posesi\u00f3n\u201d, lo que le exime de responsabilidades directas y obligaciones contables.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Velocidad:<\/strong>&nbsp;Los administradores pueden actuar con rapidez para gestionar, alquilar o preparar el inmueble para su venta.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ejecuci\u00f3n especializada:<\/strong>&nbsp;Los administradores judiciales suelen ser profesionales del sector inmobiliario que se dedican exclusivamente a maximizar la recuperaci\u00f3n de activos.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">El sistema funciona sin problemas en el caso de inmuebles comerciales o alquilados. Sin embargo, si el prestatario o el promotor se niega a abandonar el inmueble, los administradores concursales se enfrentan a obst\u00e1culos legales inmediatos.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Los hechos y la \u201cparadoja de la agencia\u201d en&nbsp;<em>Menon contra Pask<\/em>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En&nbsp;<em>Menon contra Pask<\/em>, el se\u00f1or y la se\u00f1ora Menon hipotecaron su vivienda en el oeste de Londres para garantizar una l\u00ednea de cr\u00e9dito empresarial. Cuando se produjo el impago de la l\u00ednea de cr\u00e9dito, la entidad crediticia nombr\u00f3 a dos administradores conjuntos de la garant\u00eda real para que tomaran el control del activo.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dado que los Menon permanecieron en la vivienda, los administradores judiciales iniciaron un procedimiento de recuperaci\u00f3n de la posesi\u00f3n ante el Juzgado de Primera Instancia. Basta con que tenga un derecho de posesi\u00f3n superior al del prestatario, respaldado por el contrato, que surte efecto en el momento en que la garant\u00eda subyacente se hace exigible.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El lado positivo para los prestatarios: la facultad discrecional del art\u00edculo 36&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aunque&nbsp;<em>Menon contra Pask<\/em>&nbsp;Adem\u00e1s de reforzar las opciones para los prestamistas, tambi\u00e9n introdujo una protecci\u00f3n fundamental para los prestatarios particulares de viviendas.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El tribunal examin\u00f3 si un prestatario pod\u00eda invocar <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1970\/31\/section\/36\">Art\u00edculo 36 de la Ley de Administraci\u00f3n de Justicia de 1970<\/a> para retrasar o suspender los procedimientos de ejecuci\u00f3n iniciados por un administrador judicial. Hist\u00f3ricamente, esta protecci\u00f3n solo se aplicaba a las acciones interpuestas directamente por un&nbsp;<em>acreedor hipotecario<\/em>&nbsp;(el prestamista).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El juez Mann dictamin\u00f3 que el art\u00edculo 36 s\u00ed es aplicable a las demandas de posesi\u00f3n interpuestas por los administradores judiciales. El tribunal decidi\u00f3 que el administrador judicial act\u00faa como instrumento para hacer valer los derechos de propiedad del prestamista.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En consecuencia, un prestatario particular de una vivienda puede solicitar al tribunal que aplace, suspenda o aplazara una orden de desahucio si puede demostrar que cuenta con un plan realista para saldar el pr\u00e9stamo o liquidar los atrasos en un plazo razonable.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Estrategias pr\u00e1cticas para resolver conflictos relacionados con los pr\u00e9stamos puente&nbsp;<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Estrategias para prestamistas y deudores<\/strong>&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Borrador de las cl\u00e1usulas de posesi\u00f3n expl\u00edcita:<\/strong>&nbsp;Aseg\u00farese de que los contratos de pr\u00e9stamo y los documentos legales relativos a las cargas hipotecarias indiquen expl\u00edcitamente que el acreedor hipotecario tiene el derecho directo a tomar posesi\u00f3n del inmueble desocupado por parte del deudor hipotecario.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Presenta las reclamaciones correctamente:<\/strong>&nbsp;Evita el error de designar al prestatario como demandante \u201cen nombre\u201d del administrador judicial. En ese caso, hay que centrarse en impugnar la validez del nombramiento del administrador judicial o la exactitud de la notificaci\u00f3n de incumplimiento.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Presentar pruebas realistas sobre la salida y el reembolso:<\/strong>&nbsp;Para conseguir una pr\u00f3rroga en virtud del art\u00edculo 36, los prestatarios deben presentar pruebas concretas, como una oferta formal de rescate por parte de un proveedor alternativo o un contrato de compraventa vigente y verificado.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Revisar las comisiones subyacentes de los pr\u00e9stamos:<\/strong>&nbsp;Comprueba si los tipos de inter\u00e9s de demora y las comisiones administrativas aplicadas por la entidad de cr\u00e9dito puente constituyen una penalizaci\u00f3n ilegal o dan lugar a una relaci\u00f3n desequilibrada con arreglo a la Ley de Cr\u00e9dito al Consumo de 1974.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Resumen&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La resoluci\u00f3n en&nbsp;<em>Menon contra Pask<\/em>&nbsp;equilibra el inter\u00e9s comercial con la protecci\u00f3n del consumidor en el sector de la financiaci\u00f3n puente.
