Y c\u00f3mo pueden ayudar las objeciones."},"content":{"rendered":"<p class=\"wp-block-paragraph\">Las reclamaciones contenciosas en materia de sucesiones est\u00e1n aumentando y cada vez son m\u00e1s las personas que impugnan la validez de un testamento. A menudo, los clientes no saben muy bien c\u00f3mo evitar que se expida el certificado de sucesi\u00f3n, especialmente en los casos en los que existen dudas sobre la capacidad testamentaria del testador o la testadora.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Las cl\u00e1usulas de reserva son cada vez m\u00e1s habituales y han ido en aumento en los \u00faltimos a\u00f1os, sobre todo debido a: (i) su f\u00e1cil y econ\u00f3mica accesibilidad; (ii) el valor cada vez mayor de los patrimonios; (iii) los testamentos defectuosos, y (iv) las din\u00e1micas familiares cada vez m\u00e1s variadas y los distanciamientos.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En 2023 se registraron m\u00e1s de 10 000 solicitudes, lo que supuso un aumento del 14% con respecto al n\u00famero de solicitudes presentadas en 2022.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En el \u00faltimo trimestre de 2024 se presentaron 3.061 solicitudes de reserva de derechos, lo que supuso la primera vez que se alcanzaban las 3.000 solicitudes en un solo trimestre.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Quiz\u00e1s lo m\u00e1s significativo es que los datos obtenidos, en virtud de la Ley de Libertad de Informaci\u00f3n, del Servicio de Tribunales y Juzgados de Su Majestad revelaron que en 2024 se presentaron 11 362 solicitudes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Las estad\u00edsticas anteriores reflejan el aumento generalizado de los litigios sucesorios en general (y tambi\u00e9n reflejan el incremento de los encargos que he recibido en los \u00faltimos 12 meses aproximadamente); entonces, \u00bfpor qu\u00e9 son tan significativas?&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00bfQu\u00e9 es una reserva y por qu\u00e9 se presenta una reserva?<\/strong>\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En resumen, una objeci\u00f3n es una notificaci\u00f3n por escrito presentada por el objetante para indicar que no debe expedirse una concesi\u00f3n sobre la herencia de una persona fallecida sin su previo aviso.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El solicitante de una objeci\u00f3n deber\u00e1 cumplir con la Norma 44 del Reglamento de Sucesiones No Contenciosas de 1987 (SI 1987\/2024) (\u201cNCPR 1987\u201d) y podr\u00e1 optar por presentar la objeci\u00f3n por v\u00eda telem\u00e1tica o por correo postal.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por lo general, se puede hacer constar una salvedad en los siguientes casos:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>se cuestione la validez del testamento del fallecido (es decir, puedan existir dudas sobre la capacidad del fallecido, sobre la redacci\u00f3n y formalizaci\u00f3n del testamento en general o sobre una posible influencia indebida);\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>existe la creencia de que el fallecido redact\u00f3 un testamento y no muri\u00f3 sin testamento;\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>el oponente se opone a que se conceda la autorizaci\u00f3n al representante personal, ya que puede tener dudas sobre su capacidad para administrar la sucesi\u00f3n del fallecido y\/o cumplir con sus obligaciones fiduciarias en general;\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>el oponente podr\u00eda estar tratando de iniciar un procedimiento de citaci\u00f3n (para intervenir en la administraci\u00f3n de la sucesi\u00f3n \u2014es decir, para aceptar o rechazar una concesi\u00f3n, para tramitar la sucesi\u00f3n o para presentar un testamento\u2014); y\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li>Es posible que el autor de la objeci\u00f3n tenga la intenci\u00f3n de presentar una reclamaci\u00f3n sucesoria (aunque no ser\u00eda adecuado presentar una objeci\u00f3n en los casos en que la parte en cuesti\u00f3n pretenda interponer una reclamaci\u00f3n de conformidad con la Ley de Sucesiones (Prestaciones para la Familia y las Personas a Cargo) de 1975).\u00a0<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00bfQui\u00e9n puede presentar una reserva y c\u00f3mo funciona?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sin duda, le resultar\u00e1 evidente que quien desee presentar una objeci\u00f3n debe ser mayor de edad y tener un inter\u00e9s en la sucesi\u00f3n o bien un inter\u00e9s en la misma que sea sustancialmente diferente al de la persona que solicita la concesi\u00f3n del certificado de sucesi\u00f3n.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La advertencia funciona, en esencia, como una \u201calerta\u201d y se notifica a todos los registros sucesorios. <strong>no<\/strong> conceder la validaci\u00f3n de un testamento hasta que se haya levantado la objeci\u00f3n.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La advertencia tiene una vigencia de seis meses a partir de la fecha de inscripci\u00f3n y puede renovarse cada seis meses hasta que sea retirada. Una vez m\u00e1s, resulta evidente y prudente llevar un registro de la fecha de inscripci\u00f3n de la advertencia, de su fecha de vencimiento y de la fecha en que deba prorrogarse (si procede).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si el solicitante de la reserva desea prorrogarla, deber\u00e1 presentar una solicitud de renovaci\u00f3n durante el \u00faltimo mes del periodo de seis meses en el que est\u00e1 vigente. Tenga en cuenta que la renovaci\u00f3n <strong>no puede<\/strong> se realice en l\u00ednea o por correo electr\u00f3nico, y es muy importante tener en cuenta los plazos pertinentes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La salvedad dejar\u00e1 de tener efecto en los siguientes casos:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>el opositor decide retirarla;\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>se interpone una demanda sucesoria ante el Tribunal Superior;\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>el demandado no ha presentado alegaciones ante una notificaci\u00f3n (cuyo procedimiento se detallar\u00e1 m\u00e1s adelante); y\/o\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>La notificaci\u00f3n se emiti\u00f3 para iniciar un procedimiento sancionador y: (i) el autor de la notificaci\u00f3n la ha retirado; (ii) el procedimiento sancionador ha concluido desde entonces, o (iii) el secretario judicial o un juez de distrito ha ordenado su retirada.\u00a0<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00bfC\u00f3mo se responde a una salvedad?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Si una de las partes no est\u00e1 de acuerdo con la salvedad, podr\u00e1 impugnarla y emitir una advertencia.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La advertencia deber\u00e1 formularse mediante el formulario establecido al efecto, a saber, el Formulario 4, que figura en el anexo 1 del NCPR de 1987.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En tales circunstancias, la parte deber\u00e1:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>manifiesten su inter\u00e9s en la herencia del fallecido; y\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Notificar al demandado que dispone de 14 d\u00edas para responder a la advertencia y comparecer, o bien emitir y notificar una citaci\u00f3n para que se dicten instrucciones.\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Por lo general, la advertencia la emite el Registro de Sucesiones del Distrito de Leeds y la notificaci\u00f3n se enviar\u00e1 al demandante por correo postal.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00bfQu\u00e9 puede hacer un caveador en caso de que se le impugne una advertencia?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En tales circunstancias, el demandante dispone de numerosas opciones, a saber:&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>podr\u00eda optar por no hacer nada. La persona que present\u00f3 la advertencia puede, transcurridos 14 d\u00edas, presentar una declaraci\u00f3n jurada o una declaraci\u00f3n de testigo verificada con una declaraci\u00f3n de veracidad en la que indique que hab\u00eda emitido la advertencia pero que no recibi\u00f3 ninguna citaci\u00f3n para recibir instrucciones y, a su vez, solicitar al Registro de Sucesiones del Distrito de Leeds que retire la advertencia;\u00a0\u00a0\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>podr\u00eda optar por retirar la advertencia si lo considera oportuno. En tales circunstancias, el autor de la advertencia deber\u00eda dirigirse por escrito al Registro de Sucesiones del Distrito de Leeds (ya sea presentando el formulario PA8A o notific\u00e1ndolo por correo electr\u00f3nico) y, a su vez, notificarlo a la parte que haya emitido la advertencia;\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>podr\u00eda dictar y notificar una citaci\u00f3n para que se dicten instrucciones. En este caso, el demandante deber\u00e1 presentar la citaci\u00f3n en un plazo de 14 d\u00edas, y la cuesti\u00f3n de las costas se regir\u00e1 por la Regla 60 del NCPR de 1987 (es decir, ser\u00e1n aplicables las Reglas 43, 44, 47 y 48 del CPR); o\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>podr\u00eda presentar una \u201ccomparecencia\u201d. Si un oponente decide presentar una comparecencia, deber\u00e1 utilizar el formulario 5 prescrito, que tambi\u00e9n se encuentra en el anexo 1 del NCPR de 1987. En dicho documento, el oponente deber\u00e1 exponer la naturaleza de su inter\u00e9s que entra en conflicto con el inter\u00e9s de la persona que ha presentado la advertencia. Una vez m\u00e1s, el formulario deber\u00e1 presentarse ante el Registro de Sucesiones del Distrito de Leeds en un plazo de 14 d\u00edas.
