El comunicado de prensa se centraba en las enmiendas que, seg\u00fan ellos, har\u00edan el proceso \u201cm\u00e1s justo\u201d para el arrendatario.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>El panorama del arrendamiento de larga duraci\u00f3n<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Durante m\u00e1s de tres d\u00e9cadas, la&nbsp;<em>Ley de Reforma del Arrendamiento, Vivienda y Desarrollo Urbano de 1993<\/em>&nbsp;ha regulado el arrendamiento enfranchisement. Sin embargo, esta legislaci\u00f3n ha sido fuente de pol\u00e9mica. Sus detractores argumentan que el coste de prorrogar un contrato de arrendamiento es demasiado elevado y que los incautos que adquieran contratos de arrendamiento aparentemente largos, de 99 a\u00f1os, pronto tendr\u00e1n que pagar sumas considerables para prorrogar su contrato.<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">En general, el proceso se ha considerado favorable para el propietario, ya que:<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">(1) recibir\u00edan primas potencialmente significativas, especialmente una vez que el arrendamiento cayera por debajo de los 80 a\u00f1os, ya que atraer\u00eda \u2018valor matrimonial\u2019;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">(2) el arrendatario estaba obligado a pagar los gastos procesales razonables del arrendador.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>El Gobierno mueve ficha: Proyecto de Ley de Reforma del Arrendamiento y la Propiedad Horizontal<\/strong><\/h2>\n\n\n\n<p>Al cierre de 2023, el Gobierno ha desvelado el&nbsp;<a href=\"https:\/\/bills.parliament.uk\/bills\/3523\">Proyecto de Ley de Reforma de la Propiedad Horizontal<\/a>, Actualmente se encuentra en la fase de comisi\u00f3n. El proyecto de ley introducir\u00eda las siguientes modificaciones clave en el actual sistema de arrendamiento enfranchisement:<br><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">- Eliminar el requisito de 2 a\u00f1os de propiedad para que el arrendatario pueda iniciar el proceso;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">- Aumentar la pr\u00f3rroga obligatoria de 90 a\u00f1os a la friolera de 990 a\u00f1os;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">- Eliminar el requisito de que el arrendatario pague el \u2018valor del matrimonio\u2019;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">- Eliminar la capacidad del propietario de recuperar sus costes del arrendatario en la mayor\u00eda de las situaciones.<br><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-lg-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>Franquicia colectiva<\/strong><\/h3>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Las modificaciones propuestas van m\u00e1s all\u00e1 de los arrendatarios individuales. Tambi\u00e9n se reformar\u00e1n los derechos colectivos, sobre todo en los edificios de uso mixto:<br><\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">- El l\u00edmite porcentual de zonas no residenciales en edificios de uso mixto que impedir\u00eda a los arrendatarios residenciales comprar la propiedad absoluta aumenta de 25% a 50%;<\/p>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--60)\">- Se puede obligar al arrendador a tomar en arrendamiento posterior los pisos del edificio que no participen, lo que reducir\u00eda la prima total a pagar.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>El tira y afloja: propietarios contra arrendatarios<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Aunque estas reformas suponen un soplo de aire fresco para los arrendatarios, puede que a los arrendadores no les entusiasmen tanto. Se prev\u00e9 que los grupos de presi\u00f3n de los arrendadores presionen al Gobierno para que introduzca modificaciones, especialmente sobre la supresi\u00f3n efectiva del valor conyugal. Algunos propietarios habr\u00e1n comprado inmuebles y pagado cantidades m\u00e1s elevadas bas\u00e1ndose en las futuras primas que recibir\u00edan los arrendatarios. Ahora podr\u00edan perder primas considerables sin compensaci\u00f3n alguna. Cabe preguntarse si esto ir\u00eda en contra de los derechos del arrendador, lo que podr\u00eda dar lugar a litigios en este \u00e1mbito.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-2-xl-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\"><strong>El dilema de los arrendatarios<\/strong><\/h2>\n\n\n\n<p style=\"padding-top:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20)\">Los arrendatarios se enfrentan ahora a un dilema. La tentaci\u00f3n de esperar a que estas reformas entren en vigor, asegur\u00e1ndose una pr\u00f3rroga m\u00e1s larga y ahorrando potencialmente en primas, es tentadora. Sin embargo, la incertidumbre sobre cu\u00e1ndo entrar\u00e1n en vigor estos cambios y si la versi\u00f3n final se ajusta al borrador actual suscita preocupaci\u00f3n.
