{"id":7402,"date":"2025-10-22T11:53:29","date_gmt":"2025-10-22T11:53:29","guid":{"rendered":"https:\/\/rfblegal.co.uk\/?post_type=insight&#038;p=7402"},"modified":"2025-10-22T11:57:43","modified_gmt":"2025-10-22T11:57:43","slug":"sieg-vor-dem-arbeitsgericht","status":"publish","type":"insight","link":"https:\/\/rfblegal.co.uk\/de\/einblicke\/employment-appeal-tribunal-victory\/","title":{"rendered":"Sieg vor dem Berufungsgericht f\u00fcr Besch\u00e4ftigung"},"content":{"rendered":"<p>Das Arbeitsrechtsteam von RFB hat beim Berufungsgericht f\u00fcr Arbeitsrecht (EAT) einen bedeutenden Sieg errungen und erfolgreich Berufung gegen einen Fall eingelegt, der die Bedeutung einer fairen und begr\u00fcndeten Beurteilung bei K\u00fcndigungsklagen unterstreicht. <\/p>\n\n\n\n<p>Im Oktober 2023 vertrat die Abteilung f\u00fcr Arbeitsrecht erfolgreich Jacqueline Davidson, eine Berufskraftfahrerin, bei ihrer Klage gegen National Express Limited wegen ungerechtfertigter Entlassung. Frau Davidson war bei einem Atemalkoholtest am Arbeitsplatz durchgefallen, weil sie ein Mundwasser auf Alkoholbasis benutzt hatte, das \u00fcber dem vom Unternehmen festgelegten Grenzwert lag, aber dennoch dreimal&nbsp;<strong><u>unter<\/u><\/strong>&nbsp;die nationale H\u00f6chstgrenze f\u00fcr Alkohol am Steuer.  Die nationale Promillegrenze f\u00fcr Autofahrer in England, Wales und Nordirland liegt bei 3,5 auf einem Alkoholtestger\u00e4t. Bei Frau Davidson ergab der Alkoholtest bei drei aufeinanderfolgenden Versuchen, die innerhalb kurzer Zeit durchgef\u00fchrt wurden, einen Wert von 1,3, dann 1,0 und schlie\u00dflich 0,8. Nachdem sie den Test nicht bestanden hatte, erlaubte National Express Limited Frau Davidson dennoch, selbst nach Hause zu fahren und entlie\u00df sie sp\u00e4ter.<\/p>\n\n\n\n<p>Das London East Employment Tribunal (das \u2018Gericht\u2019) befand die Entlassung f\u00fcr ungerechtfertigt, weil das Verfahren in der Berufungsphase fehlerhaft war, und erh\u00f6hte die Entsch\u00e4digung um 10% wegen Nichteinhaltung des ACAS-Kodex. Allerdings k\u00fcrzte das Gericht die Entsch\u00e4digung um 75% f\u00fcr Polkey und mitwirkendes Verhalten.<\/p>\n\n\n\n<p>Die Besch\u00e4ftigungsabteilung von RFB legte beim EAT Berufung ein und beanstandete die betr\u00e4chtliche K\u00fcrzung der Entsch\u00e4digung sowie die fehlende Begr\u00fcndung f\u00fcr die Begrenzung der Entsch\u00e4digung auf das Alter 65, da Frau Davidson der Ansicht war, dass sie mit 70 in Rente gegangen w\u00e4re. Frau Davidson legte auch Einspruch gegen die Feststellung der ungerechtfertigten Entlassung ein.<\/p>\n\n\n\n<p>Das EAT stellte fest, dass das Gericht bei der Bewertung der Verluste f\u00fcr die Zwecke der Entsch\u00e4digung einen Fehler begangen hatte. Das Gericht beschr\u00e4nkte die zugrundeliegende Berechnung des k\u00fcnftigen Verdienstausfalls auf den Zeitraum bis zum Alter von 65 Jahren und hielt dies unter allen Umst\u00e4nden f\u00fcr gerecht und angemessen. Das EAT stellte jedoch fest, dass das Gericht den zuk\u00fcnftigen Verlust, den Frau Davidson infolge der Entlassung erlitten hat und der auf die Handlungen von National Express Limited zur\u00fcckzuf\u00fchren ist, so gut wie m\u00f6glich zu bewerten hatte. Das EAT stellte auch fest, dass das Gericht es vers\u00e4umt hatte, sich mit dem Standpunkt von Frau Davidson auseinanderzusetzen, dass sie bis zum Alter von 70 Jahren arbeiten m\u00fcsste.<\/p>\n\n\n\n<p>Die Angelegenheit wurde nun zur erneuten Pr\u00fcfung an das Arbeitsgericht zur\u00fcckverwiesen.<\/p>\n\n\n\n<p>Diese Entscheidung ist ein wichtiger Hinweis darauf, dass die Gerichte den Zeitraum des Verlustes anhand aller ihnen vorliegenden Beweise beurteilen m\u00fcssen und nicht einfach ohne Begr\u00fcndung das Rentenalter zugrunde legen d\u00fcrfen.<\/p>\n\n\n\n<p>Herzlichen Gl\u00fcckwunsch an Michael Michaeloudis und Tariro Carmel Nyoka, die den Kl\u00e4ger zusammen mit Saul Margo von Outer Temple Chambers vertreten haben.<\/p>\n\n\n\n<p><\/p>","protected":false},"author":12,"featured_media":7403,"parent":0,"menu_order":0,"template":"","format":"standard","meta":{"_acf_changed":false,"om_disable_all_campaigns":false,"_uf_show_specific_survey":0,"_uf_disable_surveys":false,"footnotes":""},"categories":[67],"tags":[],"class_list":["post-7402","insight","type-insight","status-publish","format-standard","has-post-thumbnail","hentry","category-employment"],"acf":[],"aioseo_notices":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
