This means that from its inception, the logo holds immediate artistic copyright protection (Section 1(1)(c) of the same act). The importance<\/a> of this point is that copyright is an automatic right<\/a> bestowed upon creation in England<\/a>, but a Trademark is a registered right, as it offers further protections<\/a> to its owners for a specific use, in this case trade, hence the name \u201ctrademark\u201d. This distinction between copyright and trademark is crucial to understanding<\/a> the different levels of protection offered to creators and businesses.<\/p>\n\n\n\n

As a starting point whenever using any AI platform, please read its T&Cs before utilising it and creating an image, sounds or other content. This is because each AI platform wird<\/a> grant differing rights to the image you have created through your prompts.<\/p>\n\n\n\n

Let’s take a closer look at the scenario using MidJourney (at the time of this article the T&C\u2019s of MidJourney) and the distinct experiences of two types of users: the Paid<\/a> User (PU) and the Non-Paying User (NPU). Interestingly, both categories come with their own unique ‘Monkey Paw’ predicaments.<\/p>\n\n\n\n

Under MidJourney’s terms and conditions<\/a>, a Paid User (PU) is granted ownership and rights to the image created through prompts. That said, the key issue is that MidJourney reserves the right to use and sublicence the image or content created by the PU in any way it deems fit. Consequently, while the PU retains ownership, they do not possess a complete monopoly over the image compared to if they had created it entirely from scratch. The concern arises from the licensing agreement<\/a> that MidJourney holds. In the event that someone else creates a similar or identical image on MidJourney (although unlikely, it remains a possibility), or if MidJourney decides to license the intellectual property<\/a> rights of your logo to third parties, the PU will have limited recourse to prevent the use of their logo by these parties.<\/p>\n\n\n\n

When an NPU creates an image or logo on MidJourney, they won\u2019t own the image. Therefore, any application to register the IP or enforcing<\/a> your right to prevent others from using it, is practically impossible.<\/p>\n\n\n\n

Ein weiterer wichtiger Aspekt bei der Nutzung einer KI-Plattform ist, dass diese keinerlei Verantwortung f\u00fcr Probleme im Zusammenhang mit den auf ihrer Plattform erstellten Bildern oder Inhalten \u00fcbernimmt. Im ungl\u00fccklichen Fall, dass ein Dritter rechtliche Schritte einleitet, liegt es in der Verantwortung des zahlenden Nutzers oder des nicht zahlenden Nutzers, sich um die Angelegenheit zu k\u00fcmmern. Therefore, even if a PU holds the copyright to a logo, there exists the possibility that the logo may inadvertently infringe upon another<\/a> person’s copyright due to the underlying modeling techniques used. This is exemplified by the situation with StabilityAI. It underscores the need for users to be cautious and aware of potential copyright infringements that could arise from the AI platform’s algorithms and processes.<\/p>\n\n\n\n

Einfach ausgedr\u00fcckt: Die Nutzung von MidJourney zur Erstellung eines Logos ist mit Einschr\u00e4nkungen hinsichtlich des vollst\u00e4ndigen Eigentums und der Kontrolle \u00fcber die geistigen Eigentumsrechte an diesem Logo verbunden. Dies kann, in Verbindung mit der potenziellen Haftung f\u00fcr Urheberrechtsverletzungen, die M\u00f6glichkeiten eines Nutzers erheblich einschr\u00e4nken, das Logo als Marke eintragen zu lassen, es gegen\u00fcber bestimmten Dritten durchzusetzen oder gar rechtliche Schritte zu vermeiden.<\/p>\n\n\n\n

Wenn beispielsweise Logo 1 registriert ist, k\u00f6nnte es von einem anderen MidJourney-Nutzer nachgebildet oder von MidJourney an einen Dritten lizenziert werden. Was w\u00e4re in einem solchen Fall der Sinn eines Logos (oder einer eingetragenen Marke), das von einer anderen Partei verwertet werden kann? Aus diesem Grund wurde Logo 2 erstellt, mit dem Ziel, ein neues Urheberrecht zu begr\u00fcnden, das zumindest teilweise au\u00dferhalb der Lizenz von MidJourney liegt.<\/p>\n\n\n\n

Schlussfolgerung<\/strong><\/h2>\n\n\n\n

To put it bluntly: User beware. Read the T&Cs and do not buy into the social media hype, as the devil is in the details<\/a> with AI platforms (and also Crypto).<\/p>\n\n\n\n
