At Ronald Fletcher Baker LLP we have considerable experience of bringing emergency applications to the family court to protect vulnerable clients from the perpetrators of domestic violence and abuse. We are consistently aware and sensitive of the harmful impact of controlling and coercive behaviour upon its victims.
It includes the following types of abuse:
- Emotional abuse
Anyone can experience domestic violence - it doesn't matter whether you're a man or woman.
We are experienced in making a range of emergency court applications and obtaining orders which provide vital protection for victims of abuse, including Non-Molestation Orders to prevent threatening behaviour and harassment, as well as orders that determine who is able to occupy of the family home (known as Occupation Orders).
If a Non-Molestation order is breached (upon the other party being made aware of its existence), then this is an automatically arrestable offence, and criminal proceedings would potentially be instigated. This is a strong deterrent to the perpetrator to follow the terms of the court order, and provide the victim with safety and security.
Where appropriate we can also advise of remedies available under the criminal law such as the Protection from Harassment Act (1997) in addition to the civil remedies listed above.
